HomeMy WebLinkAbout083 - 06/07/1994 - AUTHORIZING A NON-EXCLUSIVE EASEMENT FOR AN UNDERGROUND IRRIGATION LINE TO THE COLORADO STATE BOARD ORDINANCE NO. 83, 1994 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY TO GRANT A NON-EXCLUSIVE EASEMENT FOR AN UNDERGROUND IRRIGATION LINE TO THE COLORADO STATE BOARD OF AGRICULTURE WHEREAS, the City of Fort Collins is the owner of the unplatted storm drainage detention area along Skyline Drive and West Elizabeth Street in Larimer County, Colorado; and WHEREAS, the Colorado State Board of Agriculture wishes to acquire a non- exclusive easement interest in the property as described in Exhibit "A", attached hereto and incorporated herein by this reference ("the Property") , to construct, operate, maintain, repair and replace an underground irrigation line; and WHEREAS, Section 23-111(a) of the City Code provides that the City Council is authorized to sell , convey or otherwise dispose of real property owned by the City, provided the Council first finds by ordinance that any sale or disposition of real property owned by the City is in the best interest of the City of Fort Collins; and WHEREAS, Section 23-111(b) of the Code provides that with respect to the real property which is a part of the City's water or utility systems, the Council must also find the disposition of the property will not materially impair the viability of the system as a whole and will be for the benefit of the citizens of the City; and WHEREAS, the value of the easement, based on the City's purchase price of the Property, is $1,995. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That the above-described sale and conveyance of a non-exclusive easement for an underground irrigation line to the Colorado State Board of Agriculture is in the best interest of the City of Fort Collins. Section 2. That the Council finds that the sale of this easement will not materially impair the viability of the City's storm drainage utility system as a whole and will be for the benefit of the citizens of the City. Section 3. That the Mayor is authorized to execute an Easement Agreement conveying a non-exclusive easement interest for an underground irrigation line to the Colorado State Board of Agriculture over, on, and under the real property described on Exhibit "A, " for the amount of One Thousand Nine Hundred Fifty-five Dollars ($1,955) . Introduced, considered favorably on first reading, and ordered published this 17th day of May, A.D. 1994, and to be presented for final passage on the 7th day of June, A.D. 1994. yor ATTEST: 1 City Clerk Passed and adopted on final reading this 7th d f June, A.D. 4. or ATTEST: (� City Clerk EXHIBIT "A" An easement located in the Northwest Quarter of Section 151 Township 7 North, Range 69 West of the 6th Principal Meridian, City of Fort Collins, Larimer County, Colorado, being more particularly described as follows: The Easterly 8 feet of the Westerly 28 feet of the following described tract: Considering the West line of the Northwest Quarter of said Section 15 as bearing North 00 degrees 00 minutes 00 seconds West and with all bearings contained herein relative thereto: Commencing at the West quarter corner of said Section 15; thence along the center section line, South 89 degrees 23 minutes 40 seconds East, 1568.99 feet; thence, North 00 degrees 36 minutes 20 seconds East, 50. 00 feet to the North right-of-way line of West Elizabeth Street, said point being the POINT OF BEGINNING; thence, North 00 degrees 03 minutes 08 seconds East, 488.75 feet; thence, . North 89 degrees 27 minutes 52 seconds West, 92. 00 feet; thence, South 00 degrees 03 minutes 08 seconds West, 488.75 feet; thence, South 89 degrees 23 minutes 40 seconds East, 92.00 feet to the Point of Beginning. The above described easement contains 3,910 square feet and is subject to all easements and rights-of-way now of record or existing.
