OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE TRANSFER OF APPROPRIATED AMOUNTS FROM
THE STREET OVERSIZING FUND TO THE CAPITAL PROJECTS FUND
FOR THE CHOICES 95 SHIELDS STREET IMPROVEMENT PROJECT
WHEREAS, by Resolution 94-87, the City Council directed the City Manager
to pre&ut for C-olmcil's consideration on or before June 7,_ 1994,_ an ordinance
appropriating such additional funds as may be necessary to complete the
construction of the Shields Street improvement projects, consisting of the
Shields Street, Laurel to Prospect, project and the Prospect-Shields Intersection
project, collectively referred to as the "Projects"; and
WHEREAS, the bids received to construct the Projects exceed the Projects'
estimate by $149,000 and are a result of higher than anticipated costs for
construction materials; and
WHEREAS, changes to the scope of the Projects and higher than expected
right-of-way acquisition expenses require an additional $50,000 in project
funding; and
WHEREAS, staff has identified available funds totalling $200,000 in the
Street Oversizing Fund, from existing appropriations, as an appropriate funding
source for the Projects' shortfall ; and
WHEREAS, Article V, Section 14, of the Charter of the City of Fort Collins
(the "Charter") , authorizes the City Council to transfer by ordinance, upon the
recommendation of the City Manager, any unexpended appropriated amount or portion
thereof from one fund to another, provided that the purpose for which the
transferred funds are to be expended remains unchanged or the purpose for which
the funds were initially appropriated no longer exist; and
WHEREAS, City Council finds that appropriating additional funds needed to
construct the Choices 95 Shields Street improvements is in the best interests of
the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the unexpended appropriated amount of TWO HUNDRED THOUSAND DOLLARS
($200,000) is authorized for transfer from the Street Oversizing Fund to the
Capital Projects Fund, Choices 95 Shields, Laurel to Prospect capital project and
appropriated therein for construction of the Projects.
Introduced, considered favorably on first reading, and ordered published
this 7th day of June, A.D. 1994, and to be presented ,final passa the
21st day of June, A.D. 1994.
