HomeMy WebLinkAbout157 - 11/02/1999 - AMENDING ORDINANCE NO. 121, 1987 BY INCLUDING IN THE LANDMARK DESIGNATION OF THE POWER PLANT BUILDIN ORDINANCE NO. 157, 1999 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING ORDINANCE NO. 121, 1987, BY INCLUDING IN THE LANDMARK DESIGNATION OF THE POWER PLANT BUILDING AND ART DECO FOUNTAIN AT 430-500 NORTH COLLEGE AVENUE THE LANDMARK DESIGNATION OF THE ROCK GARDEN, WATERWAY, POOL, AND HISTORIC PLANTINGS KNOWN AS THE "GROTTO", PURSUANT TO CHAPTER 14 OF THE CODE OF THE CITY OF FORT COLLINS WHEREAS, pursuant to Section 14-2 of the City Code, the City Council has established a public policy encouraging the protection,enhancement and perpetuation of historic landmarks within the City; and WHEREAS, by Resolution dated September 22, 1999 the Landmark Preservation Commission(the "Commission")has determined that the rock garden,waterway,pool,and historic plantings adjacent to the old Power Plant at 430-500 North College Avenue, collectively known as the "Grotto",have importance to the City for their historical and architectural importance to the old Power Plant site; and WHEREAS, the Commission has further determined that the Grotto meets the criteria of a landmark as set forth in Section 14-5 of the Code and is eligible for designation as a local landmark, and the Commission has recommended to the City Council that the Grotto be designated by the City Council as a local landmark; and WHEREAS, the property owner, the City of Fort Collins, has consented in writing to the proposed designation; and WHEREAS, such landmark designation will preserve the Grotto's importance to the community as integral part of the old Power Plant site; and WHEREAS, the City Council has reviewed the recommendation of the Commission and desires to approve such recommendation and designate the Grotto as a historic landmark. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the "Grotto", owned by the City of Fort Collins, and located within the City of Fort Collins, Larimer County, Colorado, and described as follows, to wit: (See Attachment "A") be, and hereby is, designated as a historic landmark pursuant to Chapter 14 of the Code of the City of Fort Collins. Section 2. That the Secretary of the Interior's Standards for Rehabilitation and Guidelines for Rehabilitating Historic Buildings (U.S. Department of the Interior, National Park Service, Revised 1983) shall serve as the standards by which alterations, additions and other changes to the above described features shall be reviewed for compliance with Chapter 14,Article III, of the Code of the City of Fort Collins. Introduced and considered favorably on first reading and ordered published this 19th day of October,A.D. 1999, and to be presented for final passage on the 2nd day of November, A.D. 1999. Mavor City Clerk ATTACHMENT A DESCRIPTION OF THE GROTTO HISTORIC SITE AT THE OLD CITY OF FORT COLLINS POWER PLANT A tract of land located in the Northwest Quarter of Section 12, Township 7 North, Range 69 West of the Sixth Principal Meridian, City of Fort Collins, Larimer County, Colorado, the said tract is a portion of tract J as shown on the Original Plat of the City of Fort Collins, more particularly described as follows; Commencing at the northwest corner of the said Section 12; THENCE along the west line of the said northwest quarter, South 00 degrees 00 minutes 00 seconds East for a distance of 515.03 feet; THENCE leaving the said west line, North 90 degrees 00 minutes 00 seconds East for a distance of 73.35 feet to the east line of the additional right of way for College Avenue granted to the Department of Transportation State of Colorado in a Warranty Deed dated May 3, 1994 and recorded at Reception No. 94038222 records of the Clerk and Recorder of the said Larimer County, and to the TRUE POINT OF BEGINNING of this description; THENCE leaving the said east right of way, South 72 degrees 51 minutes 42 seconds East for a distance of 72.65 feet; THENCE South 02 degrees 01 minutes 41 seconds East for a distance of 41.98 feet; THENCE South 89 degrees 27 minutes 10 seconds East for a distance of 39.81 feet; THENCE South 00 degrees 19 minutes 04 seconds East for a distance of 69.01 feet; THENCE North 69 degrees 23 minutes 45 seconds West for a distance of 74.84 feet; THENCE North 48 degrees 56 minutes 43 seconds West for a distance of 54.72 feet to the said east right of way of College Avenue; THENCE along the said east right of way,North 00 degrees 10 minutes 30 seconds East for a distance of 55.58 feet; THENCE continuing along the said east right of way, North 00 degrees 12 minutes 21 seconds East for a distance of 14.90 feet to the point of beginning. Containing 8646 square feet more less. The above described tracts are subject to all easements and rights of ways now existing or of record. I hereby state that the above description was prepared by me and is true and correct to the best of my professional knowledge, belief and opinion.
