OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE LEASE OF CITY-OWNED PROPERTY AT
4913 SOUTH COLLEGE AVENUE, FORT COLLINS, COLORADO
FOR UP TO FIVE YEARS
WHEREAS, the City of Fort Collins is the owner of the property at 4913 South College
Avenue,Fort Collins, Larimer County, Colorado; and
WHEREAS, the City desires to lease a portion of the Property, including the house more
particularly described on Exhibit "A", attached hereto and incorporated herein by this reference
(the "Residence") for a term of one year, with the City having the option to renew the lease for
additional one year terms, up to five years, at a monthly rate of at least$600.00; and
WHEREAS, the lease of the Residence is beneficial in that it will discourage vandalism
and reduce the City's costs to maintain the Property; and
WHEREAS, under Section 23-114 of the City Code, the Council is authorized to lease
any and all interests in real property owned in the name of the City, provided that Council first
finds that the lease is in the best interests of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1. That the Council hereby finds that leasing the Residence at 4913 South
College Avenue as provided herein is in the best interests of the City of Fort Collins.
Section 2. That the City Manager is hereby authorized to execute a negotiated Lease
Agreement consistent with the terms of this Ordinance, together with such additional terms and
conditions as the City Manager, in consultation with the City Attorney, determines to be
appropriate to protect the interests of the City.
Introduced, considered favorably on first reading, and ordered published this 5th day of
July, A.D. 2005, and to be presented for final passa the 19th day of July, A.D. 2005.

EXHIBIT "A"
DESCRIPTION OF THE RENTAL PROPERTY AT 4913 SOUTH COLLEGE
A tract of land located in the northeast quarter of Section 2, Township 6 North, Range 69
West of the Sixth Principal Meridian, City of Fort Collins, Larimer County, Colorado, the
said tract is also a portion of that certain tract of land described in a Special Warranty
Deed recorded January 6, 2003 at Reception No. 2003001798 records of the Clerk and
Recorder of the said Larimer County, being more particularly described as follows;
Considering the east line of the said northeast quarter of Section 2 as bearing South 00
degrees 55 minutes 05 seconds West, between a LS 20123 Aluminum Cap Monument at
the northeast corner of Section 2 and a LS 17664 Aluminum Cap Monument at the east
quarter corner of the said Section 2, and with all bearings contained herein relative thereto;
Commencing at the northeast corner of the said Section 2;
THENCE along the said east line of the northeast quarter, South 00 degrees 55
minutes 05 seconds West fora distance of 1445.86 feet to the easterly prolongation of the
north line of the said tract described at Reception No. 2003001 798;
THENCE along the said easterly prolongation and along the said north line, North
88 degrees 43 minutes 55 seconds West for a distance of 960.56 feet to the northwest
corner of the said tract described at Reception No. 2003001798 and to the TRUE POINT
OF BEGINNING of this description;
THENCE along the west line of the said tract described at Reception No.
2003001798, South 01 degrees 01 minutes 01 seconds West fora distance of 150.00 feet;
THENCE leaving the sais west line, South 88 degrees 43 minutes 55 seconds East
for a distance of 160.00 feet;
THENCE North 01 degrees 01 minutes 01 seconds East for a distance of 150.00
feet to the said north line of the tract described at Reception No. 2003001798;
THENCE along the said north line, North 88 degrees 43 minutes 55 seconds West
for a distance of 160.00 feet to the point of beginning. Containing 24000 square feet more
less.
The above described tract is subject to all easements and rights of ways now existing or
of record.
