HomeMy WebLinkAbout156 - 11/15/2005 - REZONING PROPERTY KNOWN AS THE HELLENIC PLAZA REZONING (FAILED TO PASS ON FIRST READING) ORDINANCE NO. 156, 2005 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING THE ZONING MAP OF THE CITY OF FORT COLLINS BY CHANGING THE ZONING CLASSIFICATION FOR THAT CERTAIN PROPERTY KNOWN AS THE HELLENIC PLAZA REZONING WHEREAS, Division 1.3 of the Fort Collins Land Use Code (the " d Use Code") establishes the Zoning Map and Zone Districts of the City; and WHEREAS, Division 2.9 of the Land Use Code establishes pro dures and criteria for reviewing the rezoning of land; and WHEREAS, in accordance with the foregoing, the Council considered the rezoning of the property which is the subject of this ordinance,and has determi d that the said property should be rezoned as hereafter provided; and WHEREAS,the Council has further determined that t proposed rezoning is consistent with the City's Comprehensive Plan and/or is warranted by cha d conditions within the neighborhood surrounding and including the subject property; and WHEREAS, to the extent applicable, the Co cil has also analyzed the proposed rezoning against the considerations as established in Sectio .9.4(H)(3) of the Land Use Code. NOW THEREFORE, BE IT ORD D BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That the Zoning p adopted by Division 1.3 of the Land Use Code is hereby amended by changing the zoning ssification from "MMN", Medium Density Mixed-Use Neighborhood Zone District, to "C ', Community Commercial Zone District, for the following described property in the City kn n as the Hellenic Rezoning: Commencing at a p t 50 rods South of the Northeast Corner of Section 15, Township 7 North, ge 69 West of the 6th P.M., Thence South 1 rods Thence West rods, Thence No 10 rods, Thence E t 48 rods to the POINT OF BEGINNING; EXC T that portion platted as the C.W.Johnson Subdivision,according to the Plat file April 13, 1955; O,Lots 4, 5 and 6,in the C.W. Johnson Subdivision to the City of Fort Collins, olorado, according to the Plat filed April 13, 1955; Failed 7-0 on November 15, 2005 EXCEPT portions conveyed by Deeds recorded in Book 1238, Page 537 and Book 1238, Page 538, Larimer County records; ALSO EXCEPT any portion lying in the Right of Way of Shields Street. Section 2. That the Sign District Map adopted pursuant to Sectio .7(E)of the Land Use Code be, and the same hereby is, changed and amended by showing t the above-described property is included in the Residential Neighborhood Sign District. Section 3. The City Manager is hereby authorized and rected to amend said Zoning Map in accordance with this Ordinance.
