HomeMy WebLinkAbout039 - 05/03/2005 - APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE CAPITAL PROJECTS FUND - NIX BARN RESTORATION CAPIT ORDINANCE NO. 039, 2005 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE CAPITAL PROJECTS FUND - NIX BARN RESTORATION CAPITAL PROJECT AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN FUNDS FOR THE PURPOSE OF RESTORING THE EXTERIOR OF THE NIX BARN AT THE NIX FARM NATURAL AREA, 1745 HOFFMAN MILL ROAD WHEREAS,in 1996,the City of Fort Collins purchased a 27.5 acre parcel of land containing two residences,a ramp barn,and an equipment/animal shed from Tom and Patsy Nix(the"Nix Farm Natural Area"),using proceeds from the City's dedicated 0.25 cent sales and use tax to finance the acquisition and development of open space, trails and natural areas, as approved by the voters at a municipal election on November 3, 1992; and WHEREAS,the Nix farm with its buildings,structures and sites have historical significance to the City of Fort Collins, for their association with and representation of the agricultural development of Fort Collins; and WHEREAS,on June 5,2001,City Council adopted Ordinance No.94,2001,designating the buildings, structures, and farm site know as the Nix Farm Natural Area, located at 1745 Hoffman Mill Road in Fort Collins, as an historic landmark pursuant to Chapter 14 of the Code of the City of Fort Collins; and WHEREAS, the City of Fort Collins has been awarded a grant in the amount of$97,500 from the Colorado State Historical Society's State Historical Fund for the purpose of restoring the exterior of the Nix barn on the site of the Nix Farm Natural Area (the"Project"), which grant will require the City of Fort Collins to allow the State Historical Fund staff to record a 20-year covenant on the property for its preservation; and WHEREAS, local matching funds needed to cover the cost of the project improvements, totaling$52,500,have been identified and are available in the form of existing appropriations in the Natural Areas Fund 2005 Budget; and WHEREAS, in addition, the Natural Areas Fund will contribute $1,500 to be used to incorporate art into the Project, in conjunction with the City's Art in Public Places Program, bringing the total Project cost to $151,500; and WHEREAS, Article V, Section 9,of the Charter of the City of Fort Collins (the"Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project,provided that the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, pursuant to Section 23-305 of the City Code, a City-selected artist shall participate in the design of projects for the purpose of incorporating works of art into all aspects of the project,both functional and aesthetic,to the fullest extent possible within the project budget,and be paid from the project budget; and WHEREAS, City staff has determined that the appropriation of funds from the Colorado State Historical Society's State Historical Fund as described herein will not cause the total amount appropriated in the Capital Projects Fund-Nix Barn Restoration capital project to exceed the current estimate of actual and anticipated revenues to be received during any fiscal year; and WHEREAS, it is the desire of the Council to appropriate the sum of$97,500, in the form of grant proceeds from the Colorado Historical Society's State Historical Fund, in the Capital Projects Fund-Nix Barn Restoration Capital Project,and authorize the transfer of$54,000 from the Natural Areas Fund to the Capital Projects Fund - Nix Barn Restoration Capital Project to restore the exterior of the Nix Barn at the Nix Farm Natural Area, and to incorporate art, totaling$1,500, into said project. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from unanticipated revenue in the Capital Projects Fund - Nix Barn Restoration Capital Project the sum of NINETY SEVEN THOUSAND FIVE HUNDRED DOLLARS ($97,500)to be used to restore the exterior of the Nix Barn at the Nix Farm Natural Area. Section 2. That the unexpended appropriated amount of FIFTY-FOUR THOUSAND DOLLARS ($54,000) is hereby authorized for transfer from the Natural Areas Fund to the Capital Projects Fund - Nix Barn Restoration Project, and appropriated therein, to be used to restore the exterior of the Nix Barn at the Nix Farm Natural Area, and for incorporating art, totaling $1,500, into said project. Section 3. That the Mayor is hereby authorized to execute such documents of conveyance of the covenant as the City Manager,in consultation with the City Attorney,determines to be necessary or appropriate and not inconsistent with this Ordinance.
