HomeMy WebLinkAbout161 - 11/04/1997 - VACATING RIGHT-OF-WAY FOR A PORTION OF AN ALLEY IN BLOCK 22 ORDINANCE NO. 161, 1997 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING RIGHT-OF-WAY FOR A PORTION OF AN ALLEY IN BLOCK 22, CITY OF FORT COLLINS WHEREAS,the original plat of the City of Fort Collins reserved a twenty foot wide right-of- way for an alley in Block 22 of the City of Fort Collins; and WHEREAS, because of the redevelopment of portions of Block 22, the alley is no longer needed; and WHEREAS,the City desires to retain the right-of-way only for public utility purposes; and WHEREAS, pertinent City agencies have been contacted and report no objection to the proposed vacation of the right-of-way; and WHEREAS,there will be no cost to the City in making the proposed vacation; and WHEREAS,the rights of the residents of the City of Fort Collins will not be prejudiced or injured by the vacation of said right-of-way. NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the right-of-way for alley purposes in Block 22, City of Fort Collins, more particularly described on Exhibit"A"attached hereto and incorporated herein by this reference, be and the same is,vacated, abated and abolished;reserving however,to the City said right-of-way for utility purposes only. Introduced, considered favorably on first reading, and o edFhublished 1 day of October,A.D. 1997, and to be presented for final passage o e 4 ay of N tuber D. 1997. Mayor ATTEST: City Clerk Passed and adopted on final reading this 4th day ovem A.D.- 1997. % TTEST• Mayor City Clerk EXHIBIT "A" DESCRIPTION OF THAT PORTION OF AN EXISTING 20. 00 FEET ALLEY IN BLOCK 22, CITY OF FORT COLLINS, TO BE VACATED A portion of the existing 20.00 feet wide alley to be vacated is located in the Northeast Quarter of Section 11 Township 7 North, Range 69 West of the Sixth Principal Meridian, City of Fort Collins, Larimer County, Colorado, the said alley is also located in Block 22 of the City of Fort Collins, more particularly described as follows; The existing 20.00 feet wide alley lying adjacent to and parallel with the westerly line Lots 8 through 21 inclusive, and lying adjacent to and parallel with the easterly line of Lots 22 through 35 inclusive all of the said Block 22. Containing 7000 square feet more or less. I hereby state that the above description was prepared by me and is true and correct to the best of my professional knowledge, belief and opinion.
