FOR THE USE OF CERTAIN CITY P 1 ! � ORDINANCE NO. 199, 1997 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING A LEASE AGREEMENT BETWEEN THE CITY AND TWICE THE ICE, INC., FOR THE USE OF CERTAIN CITY PROPERTY AT EPIC FOR THE SALE OF ADVERTISING SPACE WHEREAS,the City of Fort Collins is the owner of the property at 1801 Riverside Drive, Fort Collins,Larimer County, Colorado, commonly known as the Edora Pool Ice Center("EPIC"); and WHEREAS, City staff has negotiated a proposed agreement with Twice the Ice, Inc., a not- for-profit corporation established to raise funds to help provide City ice facilities for recreational use, through which Twice the Ice would be authorized to lease certain portions of EPIC,including on the ice resurfacer and on designated sections of the dasher boards, for the placement of advertising to be arranged by Twice the Ice; and WHEREAS, as the lease payment to the City for the use of EPIC space for its advertising sales, the agreement will require that Twice the Ice remit to the City ten percent (10%) of the revenues received for advertising; and WHEREAS, Twice the Ice has agreed to maintain the remaining proceeds of funds raised from its sale of advertising in EPIC in a City-managed account, and to donate all such funds to the City upon completion of the project or termination of the agreement, for use by the City in constructing a second ice rink at EPIC in accordance with the City's Building Community Choices ballot measure,or for other recreational programs if sufficient funds are not raised for that rink; and WHEREAS, under Section 23-114 of the Code of the City of Fort Collins, the Council is authorized to lease any and all interests in real property owned in the name of the City,provided that Council first finds that the lease is in the best interests of the City; and WHEREAS,the Council, having considered the benefits to the City of the proposed lease arrangement that staff has negotiated with Twice the Ice,finds that agreement and the grant to Twice the Ice of the right to use certain portions of EPIC for the sale advertising to be in the best interests of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Council hereby determines that the proposed Lease Agreement for use of certain portions of EPIC by Twice the Ice, Inc., for the sale and display of advertising for a term of one year, with four optional one-year renewals, is in the best interests of the City, and hereby authorizes the City Manager to enter into such agreement consistent with the terms hereof.
