T ORDINANCE NO. 52, 1997 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING THE ZONING DISTRICT MAP OF THE CITY WHEREAS,the City of Fort Collins, as a home-rule municipality, is authorized by Article XX, Section 6 of the Colorado Constitution,the provisions of state statutes and its City Charter to develop and implement policies and ordinances regulating the development of land within the City; and WHEREAS,the City has previously adopted various elements of its Comprehensive Plan, as well as various sections of its City Code pertaining to zoning and development of land, including certain provisions contained in Chapter 29, Article III, Division 5 of the City Code, known as the Land Development Guidance System for Planned Unit Developments, and certain provisions contained in Chapter 29, Article V of the Code pertaining to the general subdivision of land; and WHEREAS,the City has completed the process of developing a new Comprehensive Plan, known as the "City Plan," which serves to integrate the various elements of the City's Comprehensive Plan and allow for individual land use proposals to be evaluated by the City within an improved, overall planning context, rather than on a site specific basis only; and WHEREAS,pursuant to Resolution 97-25, the Council of the City of Fort Collins adopted the Community Vision and Goals 2015, City Structure Plan, and City Plan Principles and Policies as elements of the Comprehensive Plan of the City,which documents serve, among other things, as a compilation of fundamental Principles upon which the City Plan will be implemented,and include policies regarding how the implementation ought to proceed; and WHEREAS,in pursuance of the Community Vision and Goals 2015,the City Structure Plan and the City Plan Principles and Policies,the staff and professional consultants of the City,together with the City Plan Advisory Committee and other citizen groups of the City, have prepared and presented to the Council a new land use regulatory system to be known as the "Land Use Code," which system includes the comprehensive rezoning of the City as well as new standards and criteria that will be used to regulate the location,timing and design of new development within the City, all in furtherance of the City Plan as adopted by the Council pursuant to Resolution 97-25; and WHEREAS, by the adoption of Ordinance No. 51, 1997, the City Council has, this same date, adopted the Land Use Code; and WHEREAS, in furtherance of the purposes of the Community Vision and Goals 2015, the City Structure Plan, and the City Plan Principles and Policies, in conjunction with the adoption of the"Land Use Code,"the Council has determined that the zoning district map of the City should be comprehensively amended; and WHEREAS,after notice and hearing,on February 24, 1997,the Planning and Zoning Board has recommended to the City Council that the zoning map be comprehensively amended as provided herein. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the aforesaid recitals of fact are hereby incorporated into this Ordinance as findings and determinations of the City Council. Section 2. That the"Zoning Map of the City of Fort Collins,Colorado"dated March 28, 1997, (the "Zoning Map") is hereby adopted as the official zoning map of the City with the amendment shown on Exhibit`B"attached hereto, and all other zoning maps (a/k/a zoning district maps)of the City heretofore adopted shall be of no further force and effect except to the extent that such map(s) is necessary for the review of pending land development applications which are permitted to be processed under the City's existing land use regulations pursuant to Ordinance No. 161, 1996. The Zoning Map is hereby made a part of this Ordinance by reference, and is available for inspection in the City Clerk's Office, 300 LaPorte Avenue, City Hall West, Fort Collins, Colorado. Section 3. That the property at 424-428 Maple Street shall remain in the C-Commercial Zone District, subject to the following limitations: a. Uses permitted subject to administrative review shall be limited to the following: 1. Minor vehicle repair(indoor) 2. Frozen food lockers 3. Workshops and custom small industry 4. Offices, financial services, and clinics 5. Personal and business service shops 6. Plumbing, electrical & carpentry shops 7. Retail establishments 8. Warehouses & enclosed storage 9. Multi-family dwellings b. Uses permitted subject to review by the Planning and Zoning Board shall be limited to the following: 1. Parking lots and parking garages as a principal use. 2. Public and private schools for college, university, vocational or technical training. 2 0 0 C. Any use allowed in the N-C-M zone shall be permitted through the process for use approval described in the N-C-M zone. d. Any outside storage which occurs as an accessory use to one of the above-referenced permitted uses must be screened from surrounding residential properties by opaque fencing and/or landscaping.
