HomeMy WebLinkAbout100 - 09/03/1985 - VACATING THE EASEMENTS AND RIGHTS-OF-WAY FOR A PORTION OF THE ORIGINAL PLAT OF GREENBRIAR SUBDIVISIO ORDINANCE NO. 100, 1985 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING THE EASEMENTS AND RIGHTS-OF-WAY FOR A PORTION OF THE ORIGINAL PLAT OF GREENBRIAR SUBDIVISION AND THE EASEMENTS AND RIGHTS-OF-WAY FOR THE SAME PORTION OF THE VAL VISTA ANNEXATION AND ZONING PLAT WHEREAS, the Council of the City of Fort Collins has been petitioned to vacate the easements and right-of-way for a portion of the original plat of the Greenbriar Subdivision and the easements and rights-of-way for the same portion of the Val Vista Annexation and Zoning plat set forth in more particular below; and WHEREAS, on July 24, 1985, the Planning and Zoning Board approved the replat of the Greenbriar Subdivision which replat affected the easements and rights-of-way as dedicated on the original plats of Greenbriar and a portion of the Val Vista Annexation and Zoning plat; and WHEREAS, the vacations requested in this ordinance remove certain easements and rights-of-way which will allow for the development of the approved and recorded replat of the Greenbriar Subdivision ; and WHEREAS, all utilities have been contacted and indicate no problems with the vacation ; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that those certain easements and rights-of-way located in the original plat of Greenbriar Subdivision and portion of the Val Vista Annexation and Zoning plat set out more particularly as follows, to wit: A part of Greenbriar situate in the North 1/2 of the Northeast 1/4 of Section 1, Township 7 North, Range 69 West of the Sixth P.M. , City of Fort Collins, Larimer County, Colorado, which considering the North line of the said Northeast 1/4 as bearing S 89°56' 14" E and with all bearings contained herein relative thereto is contained within the boundary lines which begin at a point on the East line of the said Northeast 1/4 which bears S 00004' 13" E 190.00 feet from the Northeast corner of said Section 1, and run thence along said East line S 00°04'13" E 1124.24 feet, to the Southeast corner of the North 1/2 of the said Northeast 1/4; thence along the South line of the North 1/2 of the said Northeast 1/4, N 89°50' 18" W 1903.58 feet; thence N 00010'00" E 215.00 feet ; thence N 35°00'00" E 73.39 feet ; thence along the arc of a 700.00 foot radius curve to the right, a distance of 342.99 feet, the long chord of which bears N 40037' 13" W 339.57 feet ; thence N 26°35'00" W 184.73 feet; thence N 63025'00" E 161.85 feet along the Easterly line of the Replat of Sandcreek Village, P.U.D., and again along the arc of a 677.21 foot radius curve to the left, a distance of 357.54 feet, the long chord of which bears N 48°17' 30" E 353.40 feet; and again along the arc of a 430.00 foot radius curve to the right, a distance of 277.43 feet, the long chord of which bears N 51039' 00" E 272.64 feet ; and again N 16000'40" W 141.29 feet to the North line of the said Northeast 1/4; thence along said North line, S 89056' 14" E 1284.57 feet; thence S 47°26'45" E 162.90 feet; thence S 57°23'50" E 148.66 feet ; thence S 89056' 14" E 50.00 feet to the point of beginning containing 55.9871 acres more or less. And those easements dedicated by instrument recorded May 8, 1981 in Book 2114, Page 1032 of the records of the Clerk of Larimer County, Colorado. be, and the same hereby are, vacated, abated and abolished.
