HomeMy WebLinkAbout070 - 08/06/1985 - AMENDING THE CITY CODE RELATING TO THE PROHIBITION OF UNREASONABLE NOISE r i ORDINANCE NO. 70 , 1985 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING THE CODE OF THE CITY OF FORT COLLINS RELATING TO THE PROHIBITION OF UNREASONABLE NOISE WHEREAS, the present Section 78-1 of the Code of the City of Fort Collins provides that it is unlawful to make certain excessive or unusually loud noises; and WHEREAS, such section is unnecessarily broad and of limited value in describing noises which are prohibited; and WHEREAS, it is desirable to amend Chapter 78 so that the problem of unreasonable noise can be addressed by the Police Department without the necessity of acquiring and using sound-measuring equipment and specially trained personnel and without the necessity of a citizen complainant. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Section 78-1 of the Code of the City of Fort Collins be, and the same hereby is, repealed and readopted as follows: §78-1. Unreasonable noise prohibited. It shall be unlawful for any person to make, continue or cause to be made or continued, any unreasonable noise in the City of Fort Collins. For purposes of this section, members of the Police Department are empowered to make a prima facie determination as to whether a noise is unreasonable. Introduced, considered favorably on first reading, and ordered published this 16th day of July, A.D. 1985, and to be presented for final passage on the 6th day of August, A.D. 1985.
