HomeMy WebLinkAbout026 - 02/19/2002 - ZONING WEBSTER FARM ANNEXATION ORDINANCE NO. 026, 2002 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING THE ZONING MAP OF THE CITY OF FORT COLLINS AND CLASSIFYING FOR ZONING PURPOSES THE PROPERTY INCLUDED IN THE WEBSTER FARM ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO WHEREAS, Division 1.3 of the Land Use Code of the City of Fort Collins establishes the Zoning Map and Zone Districts of the City; and WHEREAS, Division 2.8 of the Land Use Code of the City of Fort Collins establishes procedures and criteria for reviewing the zoning of land; and WHEREAS,in accordance with the foregoing,the Council has considered the zoning of the property which is the subject of this ordinance,and has determined that the said property should be zoned as hereafter provided. NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Zoning Map of the City of Fort Collins adopted pursuant to Section 1.3.2 of the Land Use Code of the City of Fort Collins be, and the same hereby is, changed and amended by including the property known as the Webster Farm Annexation to the City of Fort Collins, Colorado, in the Low Density Mixed-Use Neighborhood District (L-M-N) Zone District, which property is more particularly described as situate in the County of Larimer,State of Colorado, to wit: A parcel of land being part of the Southwest Quarter (SW 1/4) of Section Four (4), THE SOUTHEAST QUARTER (SE1/4) OF SECTION FIVE (5), AND THE NORTHWEST QUARTER(NW 1/4)OF SECTION NINE(9),ALL IN TOWNSHIP SIX NORTH (T.6N.), RANGE SIXTY-EIGHT WEST (R.68W.) OF THE SIXTH PRINCIPAL MERIDIAN (6TH P.M.), COUNTY OF LARIMER, STATE OF COLORADO AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE WEST QUARTER CORNER OF SAID SECTION 4 AND ASSUMING THE WEST LINE OF SAID S W 1/4 AS BEARING SOUTH 01°45'54" EAST, BEING A GRID BEARING OF THE COLORADO STATE PLANE COORDINATE SYSTEM, NORTH ZONE, NORTH AMERICAN DATUM 1983/92, A DISTANCE OF 2553.31 FEET WITH ALL OTHER BEARINGS CONTAINED HEREIN RELATIVE THERETO: THENCE SOUTH 88°53'29"EAST ALONG THE NORTH LINE OF SAID SWIM A DISTANCE OF 30.04 FEET TO THE EAST R.O.W. LINE OF LARIMER COUNTY ROAD#9(ZIEGLER ROAD),SAID POINT BEING THE TRUE POINT OF BEGINNING; THENCE CONTINUING SOUTH 88°53'29" EAST ALONG THE NORTH LINE OF SAID SW 1/4, SAID LINE ALSO BEING THE SOUTH LINE OF HARMONY FARM ANNEXATION A DISTANCE OF 2624.13 FEET TO THE CENTER QUARTER CORNER OF SAID SECTION 4; THENCE SOUTH 01°49'40"EAST ALONG THE EAST LINE OF SAID SW 1/4 A DISTANCE OF 2564.85 FEET TO THE NORTH R.O.W. LINE OF LARIMER COUNTY ROAD #36 (LCR #36) (KECHTER ROAD), BEING ALONG THE WEST LINE OF WILLOW BROOK ANNEXATION NO. 1 AND ALONG THE WEST LINE OF THE WILLOW BROOK ANNEXATION NO. 2; THENCE NORTH 87°59'57" WEST ALONG SAID NORTH R.O.W. LINE A DISTANCE OF 1597.46 FEET; THENCE SOUTH 02 °00'03" WEST A DISTANCE OF 60.00 FEET TO THE SOUTH R.O.W. LINE OF SAID LCR#36; THENCE NORTH 87"59'57"WEST ALONG THE SOUTH R.O.W.LINE OF SAID LCR #36 A DISTANCE OF 1028.87 FEET TO THE EAST LINE OF H.H.-36 ANNEXATION; THENCE ALONG THE EAST R.O.W. LINE OF SAID LCR #9 BY THE FOLLOWING TWO (2) COURSES AND DISTANCES AND THE EAST AND NORTH LINES OF SAID H.H.-36 ANNEXATION BY THE FOLLOWING FOUR (4) COURSES AND DISTANCES; THENCE NORTH 00°00'25" WEST A DISTANCE OF 31.47 FEET; THENCE NORTH 01°45'54" WEST A DISTANCE OF 711.60 FEET; THENCE SOUTH 88*07'11"WEST A DISTANCE OF 30.00 FEET TO THE WEST LINE OF SAID SOUTHWEST QUARTER; THENCE NORTH 81 °25'49" WEST A DISTANCE OF 30.49 FEET TO THE WEST R.O.W. LINE OF SAID LCR#9; THENCE NORTH 01°45'54"WEST ALONG THE WEST R.O.W.LINE OF SAID LCR#9 A DISTANCE OF 1212.57 FEET; THENCE ALONG THE SOUTH AND EAST LINES OF THE RUFF ANNEXATION THE FOLLOWING TWO (2) COURSES AND DISTANCES; THENCE SOUTH 88"33'48"EAST A DISTANCE OF 60.09 FEET TO THE EAST R.O.W. LINE OF SAID LCR#9; THENCE NORTH 01°45'54"WEST ALONG THE EAST R.O.W. LINE OF SAID LCR#9 A DISTANCE OF 626.10 FEET TO THE TRUE POINT OF BEGINNING. SAID DESCRIBED PARCEL OF LAND CONTAINS 156.249 ACRES,MORE OR LESS (±) AND IS SUBJECT TO ANY RIGHTS-OF-WAY OR OTHER EASEMENTS AS GRANTED OR RESERVED BY INSTRUMENTS OF RECORD OR AS NOW EXISTING ON SAID DESCRIBED PARCEL OF LAND. Section 2. That the Sign District Map adopted pursuant to Section 3.8.7(E) of the Land Use Code of the City of Fort Collins be, and the same hereby is, changed and amended by showing that the above-described property is included in the Residential Neighborhood Sign District. Section 3. That the City Engineer is hereby authorized and directed to amend said Zoning Map in accordance with this Ordinance.
