HomeMy WebLinkAbout009 - 02/20/1996 - AMENDING CITY CODE TO CHANGE NAME OF THE CABLE TV BOARD TO THE TELECOMMUNICATIONS BOARD AND TO BROAD ORDINANCE NO. 9, 1996 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING DIVISION 8 OF CHAPTER 2 OF THE CITY CODE TO CHANGE THE NAME OF THE CABLE TV BOARD TO THE TELECOMMUNICATIONS BOARD AND TO BROADEN ITS FUNCTION WHEREAS, the Cable TV Board was created in 1987 from a merger of the Cable Advisory Board and the Public Access Advisory Board; and WHEREAS, the Cable TV Board has effectively advised the City Council with regard to cable television issues in the City of Fort Collins; and WHEREAS, the current telecommunications environment is rapidly changing and evolving into a competitive marketplace with multiple providers of voice, video and data communications; and WHEREAS,as a result it will become increasingly important in the future for the City of Fort Collins to effectively manage its physical infrastructure and to promulgate such zoning requirements and other regulatory measures as may be necessary to ensure the organized and beneficial delivery of telecommunications services to the citizens of Fort Collins; WHEREAS, to accomplish this it is in the best interest of the City to change the name of the Cable TV Board to the Telecommunications Board and to broaden its function to that of advising the City Council on all telecommunications related issues; and WHEREAS, pursuant to the terms of the current Franchise Agreement between the City and Columbine, Columbine is required to send a representative to all Board meetings to discuss cable tv issues; and WHEREAS, the provision in Section 2-137(a) of the Code appointing a Columbine representative as an ex-officio member of the Board is no longer necessary. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS, that Division 8 of Chapter 2 of the Code of the City of Fort Collins be hereby amended by amending the following Code sections: Section 1. That Section 2-136 is hereby amended to read as follows: See. 2-136. Creation. There shall be and is hereby created a Telecommunications Board, hereafter referred to in this Division as the "board." Section 2. That Section 2-137(a) is hereby amended to read as follows: Sec. 2-137. Membership; term. (a) The board shall consist of seven (7) members appointed by the City Council. Section 3. That Section 2-138 is hereby amended to read as follows: Sec. 2-138. Function. The board shall advise the City Council on all telecommunications related issues, including but not limited to cable television and telephony. Section 4. That Division 8, as amended, is hereby renumbered as Division 31, that Sections 2-136 through 2-140 are hereby renumbered as Sections 2-418 through 2-422 and that the existing Divisions 31 through 34 are hereby renumbered as Divisions 32 through 35.
