HomeMy WebLinkAbout062 - 05/21/1996 - APPROPRIATING UNANTICIPATED REVENUE FOR THE USE OF CAMERA RADAR AND RED LIGHT CAMERAS TO ENFORCE TRA ORDINANCE NO. 62, 1996 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN TILE GENERAL FUND FOR THE USE OF CAMERA RADAR AND RED-LIGHT CAMERAS TO ENFORCE TRAFFIC VIOLATIONS WHEREAS, a significant share of traffic accidents and fatalities are caused by motorists ignoring the legal speed limits; and WHEREAS, the existing traffic law enforcement resources of Fort Collins Police Services cannot adequately address this problem and, therefore, there is need for an allerua6ve means of traffic speed and traffic signal enforcement; and WHEREAS, automated camera-radar and red-light camera enforcement systems that use radar and/or a camera to record motorists violating speed limits have been shown in other communities to be a significant deterrent to speeding violations and violations at traffic signals when motorists are aware that such automated systems are being used in their community; and WHEREAS, after conducting a competitive bidding process, American Traffic Systems has been selected by the City as its contractor to provide camera radar and red-light camera services for the enforcement of traffic violations (the "ATS Contract"); and WHEREAS, based upon the number of present violations and corresponding fine amounts, it is projected that the traffic citations that will be issued through (lie use of camera radar and red- light camera enforcement systems will generate approximately $600,000 in unanticipated revenue in the General Fund; and WHEREAS, the unanticipated revenue from such citations will be available to make the estimated ATS Contract payment of approximately $400,000; and WHEREAS, a contractual Municipal Court Clerk is needed to handle the increased case load associated with the use of such traffic enforcement systems at a cost of$27,000; and WHEREAS, Article V, Section 14, of the Charter of the City of Fort Collins permits the City Council to appropriate by ordinance unanticipated revenue which is the result of rate or fee increases or new revenue sources at any time during the year in which such revenue is received. NOW, THEREFORE, BE 1T ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that: Section I. There is hereby appropriated for expenditure from unanticipated revenue in the General Fund, upon the City's receipt of such revenue, the sum of FOUR HUNDRED THOUSAND DOLLARS ($400,000) for expenditure in Police Services to make payments to American Traffic Systems in accordance with the ATS Contract. Section 2. There is hereby appropriated for expenditure front unanticipated revenue in the General Fund, upon the City's receipt of such revenue, the stun of TWENTY-SEVEN THOUSAND DOLLARS ($27,000) for expenditure in the Municipal Court for a contractual municipal court clerk to handle the increased case load associated with the City's use of camera radar and red-light camera traffic enforcement systems. lutrodllced, considered favorably on first reading and ordered 1t hed this 7th day of May, A.D. 1996, and to be presented for final passage on the 21 sl day of MA.D. 1996 Mayor ATTEST: qyu City Clerk Passed and adopted on final reading this 21st day of D 1996.
