OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING FUNDS FROM PRIOR YEAR RESERVES AND
AUTHORIZING THE TRANSFER OF APPROPRIATED AMOUNTS
BETWEEN FUNDS FOR THE PURPOSE OF PROVIDING ADDITIONAL
AMOUNTS NEEDED TO CONSTRUCT BICYCLE AND PEDESTRIAN
IMPROVEMENTS FOR THE CHOICES 95
DRAKE/COLLEGE INTERSECTION PROJECT
WHEREAS,the Drake/College Intersection project(the"Project') is one of the Choices 95
capital improvement projects approved by the voters in 1989, and scheduled for construction in June
of 1996; and
WHEREAS, the scope of the project as originally developed, prior to the Choices 95
election, included double left turn lanes on College Avenue, right turn lanes at the corners, storm
sewer, traffic signal, and landscaping improvements; and
WHEREAS, during preliminary design of the Project, certain additional proposed
improvements for bicycles, pedestrians and vehicles ("the Additional Improvements") were
identified which were outside the original scope of the project; and
WHEREAS,the Additional Improvements include the addition of on-street bicycle lanes on
East Drake from College one block east to Harvard, the addition of sidewalk on the south side of
West Drake from College one block west to McClelland, and the construction of a second left turn
lane form West Drake onto northbound College; and
WHEREAS,preliminary cost estimates identified for the Additional Improvements were (1)
on-street bicycle lanes on East Drake $400,000, (2) sidewalk on West Drake $100,000, and (3)
double left turn lanes on West Drake $206,000; and
WHEREAS, the high cost of the Additional Improvements is related primarily to the costs
of acquiring the necessary right-of-way (ROW) from affected businesses; and
WHEREAS, the City Manager and Transportation Services Director have prioritized the
Additional Improvements and,based upon available funding sources, recommend that only the on-
street bicycle lanes on East Drake and the sidewalk on West Drake (the "Recommended
Improvements") be included in the Project scope; and
WHEREAS, the $500,000 needed for the Recommended Improvements at the intersection
is available using a combination of remaining funds in the 1/4 Cent Necessary Capital Projects Fund,
reserves in the Sales and Use Tax Fund, and monies from the Street Oversizing Fund; and
WHEREAS, it is the desire of Council to appropriate the sum of$500,000 from available
sources, as identified by Staff,to be used to provide the Recommended Improvements as part of the
construction of the Drake/College Intersection project improvements; and
WHEREAS, Article V, Section 7 of the Charter of the City of Fort Collins (the "Charter")
authorizes the City Council to provide by ordinance for payment of any expense from reserves
accumulated in prior years notwithstanding that such reserves were not appropriated for expenditure
in the Annual Appropriation Ordinance; and
WHEREAS, Article V, Section 14, of the Charter authorizes the Council to transfer by
ordinance,upon the recommendation of the City Manager, any unexpended appropriated amount or
portion thereof from one fund to another,provided that the purpose for which the transferred funds
are to be expended remains unchanged; and
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Recommended Improvements are hereby approved by the Council, with funding
for the same to be provided as follows:
Section 1. That there is hereby appropriated for expenditure from prior year reserves in the
1/4 Cent Necessary Capital Projects Fund the sum of SEVENTY-FIVE THOUSAND DOLLARS
($75,000) and authorized for transfer to the Choices 95 Capital Projects Fund and appropriated
therein for on-street bicycle lanes on East Drake and sidewalk on West Drake as part of the Choices
95 Drake/College Intersection capital project.
Section 2. That there is hereby appropriated for expenditure from prior year reserves in the
Sales and Use Tax Fund the sum of ONE HUNDRED SEVENTY-FIVE THOUSAND DOLLARS
($175,000) and authorized for transfer to the Choices 95 Capital Projects Fund and appropriated
therein for on-street bicycle lanes on East Drake and sidewalk on West Drake as part of the Choices
95 Drake/College Intersection capital project.
Section 3. That there is hereby appropriated for expenditure from prior year reserves in the
Street Oversizing Fund the sum of TWO HUNDRED FIFTY THOUSAND DOLLARS ($250,000)
and authorized for transfer to the Choices 95 Capital Projects Fund and appropriated therein for on-
street bicycle lanes on East Drake and sidewalk on West Drake as part of the Choices 95
Drake/College Intersection capital project.
