HomeMy WebLinkAbout059 - 05/21/1996 - AUTHORIZING A LEASE TO THE POUDRE LANDMARKS FOUNDATION OF THE HISTORIC WATER WORKS PROPERTY AT 2005 ORDINANCE NO. 59, 1996 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY OF FORT COLLINS TO LEASE TO THE POUDRE LANDMARKS FOUNDATION THE CITY'S HISTORIC WATER WORKS PROPERTY LOCATED AT 2005 NORTH OVERLAND TRAIL WHEREAS, the City of Fort Collins is the owner of an approximately 25-acre parcel of real property located at 2005 North Overland Trail, Fort Collins, Colorado (the "Property"); and WHEREAS, there is presently located on the Property four structures which constitute the City's Historic Water Works Site; and WHEREAS, the structures that are located on the Property include the City's historic Water Works building (which was built in 1883), a caretaker's residence, and outbuildings (the "Buildings"); and WHEREAS, the Buildings are in need of rehabilitation, reconstruction and restoration; and WHEREAS, the City and the Poudre Landmarks Foundation (the "Foundation") desire to work together for the rehabilitation, reconstruction and restoration of the Buildings; and WHEREAS, City staff and the Foundation have negotiated a lease agreement ("Lease Agreement") for the Foundation's proposed lease of the Property; and WHEREAS, a copy of the Lease Agreement is on file with the City Clerk; and WHEREAS, the Lease Agreement provides that the Foundation will lease the Property for a term of fifteen (15) years for a total aggregate rental of Fifteen Dollars ($15.00); and WHEREAS, the Lease Agreement also provides that the Foundation will work towards restoring the interior of the Water Works building located on the Property and develop the site into an interpretive center/museum for water; and WHEREAS, leasing the Property to the Foundation will serve the public purposes of preserving the Property as an important historic site and providing the public with an educational opportunity relating to the importance of water in the historical development of this community; and WHEREAS, City Code Sec. 23-114 authorizes the City to lease any real property which is part of the City's water utility system for a term of two years or more, if the Council first finds, by ordinance, that the lease is in the best interests of the City, that such lease will not materially impair the viability of the City's water utility system as a whole, and that it will be for the benefit of the citizens of the City. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS, as follows: Section 1. That the Council hereby finds that leasing the Property to the Foundation pursuant to the terms of the Lease Agreement will serve the public purposes of preserving an historic site and of providing citizens with an educational opportunity and further funds that it is in the best interests of the City, will not materially impair the viability of the City's water utility system as a whole, and will be for the benefit of the citizens of the City. Section 2. That the Lease Agreement is hereby approved. Section 3. That the Mayor be, and hereby is, authorized to execute the Lease Agreement and any and all other legal instruments as are necessary for the City to lease the Property to the Foundation for the purposes and upon the terms and conditions described above.
