HomeMy WebLinkAbout127 - 09/04/2001 - AUTHORIZING THE TRANSFER OF APPROPRIATIONS TO BE USED FOR OPERATING EXPENSES OF THE METROPOLITAN PLA ORDINANCE NO. 127, 2001 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE TRANSFER OF APPROPRIATIONS FROM THE TRANSPORTATION SERVICES FUND TO THE NORTH FRONT RANGE TRANSPORTATION & AIR QUALITY PLANNING COUNCIL FUND TO BE USED FOR OPERATING EXPENSES OF THE METROPOLITAN PLANNING ORGANIZATION WHEREAS, the North Front Range Transportation & Air Quality Planning Council (the "NFRT & AQPC") is the Metropolitan Planning Organization (MPO) and lead air quality planning agency for the North Front Range region; and WHEREAS, voting members of the MPO include Fort Collins, Greeley, Loveland, Evans, Timnath, Windsor, Berthoud, LaSalle, Johnstown, Garden City, Larimer County, Weld County, the State of Colorado Transportation Commission, and the State of Colorado Air Quality Control Commission; and WHEREAS, the funds for the administration of the MPO program are federal transportation program funds appropriated by the federal government and administered by the Colorado Department of Transportation (CDOT), based on the federal fiscal year of October 1 through September 30; and WHEREAS, under the terms of an intergovernmental agreement, dated July 6, 1998, between the City and the MPO, entitled Intergovernmental Agreement for the Provision of Support Services, the City provides an Executive Director and the administrative services to the MPO, including accounting and financial services, purchasing services, risk management services, budgeting services, human resource services, and legal services, and accordingly, manages federal grant revenue and matching funds received on behalf of the MPO; and WHEREAS, the City and the MPO have subsequently entered into a new Intergovernmental Agreement for the provision of support services, dated May 17, 2001; and WHEREAS, according to the terms of the new agreement, the City will no longer provide an Executive Director to the MPO; and WHEREAS, on July 2, 2001, the NFRT & AQPC hired a full-time Executive Director, to replace the Executive Director provided by the City to the MPO; and WHEREAS, the recently-hired Executive Director, is not considered an employee of the City of Fort Collins and cannot be compensated using City funds; and WHEREAS, the Finance Director of the City of Fort Collins has approved the creation of a new fund (established with a new federal taxpayer identification number), the name of which shall be the North Front Range Transportation & Air Quality Planning Council Fund, with said fund to be used to compensate the employees of the MPO and pay future expenses of the MPO beginning with the 2001 —2002 MPO year; and WHEREAS, federal funds ($50,000), for use by the MPO, and required local matching funds ($3,621) have been identified in the City's Transportation Services Fund; and WHEREAS, the aforementioned funds are available for transfer to the newly-created North Front Range Transportation & Air Quality Planning Council Fund, to be used to compensate the Executive Director of the MPO for the remainder of the calendar year 2001; and WHEREAS, CDOT will permit unexpended funds, totaling $50,000, and matching funds totaling $3,621, remaining in the 2000-2001 MPO year, to be reallocated to the North Front Range Transportation & Air Quality Planning Council Fund to be used to compensate the Executive Director of the MPO for the remainder of the calendar year 2001; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from fund or capital project to another fund or capital project provided that the purpose for which the funds were initially appropriated remains unchanged. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the unexpended and unencumbered amount of FIFTY-THREE THOUSAND SIX HUNDRED TWENTY-ONE DOLLARS ($53,621) is hereby authorized for transfer from the 2000-2001 MPO grant program, with $50,000 representing federal funds from the Colorado Department of Transportation and $3,621 representing local matching funds, to the North Front Range Transportation & Air Quality Planning Council Fund, to be used to compensate the newly-hired Executive Director of the MPO.
