HomeMy WebLinkAbout065 - 05/04/2004 - AUTHORIZING THE ACCEPTANCE OF A .25 ACRE PROPERTY DONATED BY SPRINGFIELD SUBDIVISION 6TH FILING JOIN ORDINANCE NO. 065, 2004 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE ACCEPTANCE OF A .25 ACRE PROPERTY DONATED BY SPRINGFIELD SUBDIVISION SIXTH FILING JOINT VENTURE AND APPROPRIATING THE VALUE OF SAID DONATED PROPERTY AS UNANTICIPATED REVENUE IN THE NATURAL AREAS FUND WHEREAS, Springfield Sixth Filing Joint Venture is the owner of approximately .25 acres of land located adjacent to the City's Pineridge Natural Area, more particularly described as Tract A, Overland Hills 1st Filing, City of Fort Collins, County of Larimer, State of Colorado (the "Property"); and WHEREAS, City Real Estate Services staff has estimated the fair market value of the Property at $1,250; and WHEREAS, pursuant to Ordinance No. 029, 1997 and Resolution 1998-062, Building Community Choices tax revenues are available for: the protection of natural areas and other categories of open lands, such as corridors, community separators, gateways, edges, and small urban pockets; the permanent protection of significant natural areas and other open lands through land and water acquisition, conservation easements and other techniques; the restoration or enhancement of disturbed or degraded areas, the installation of parking areas, trails, interpretive signs, and other features for appropriate public use; the development of environmental interpretation programs; and the continuation of a stewardship fund to provide long-term programs care of protected lands; and WHEREAS, the City's Natural Resources staff has reviewed the resource, natural heritage and open space values of the Property, and has determined that the Property would provide a valuable opportunity to advance the objectives of the Natural Areas Policy Plan; and WHEREAS, Springfield Sixth Filing Joint Venture has agreed to donate the Property to the City for use by the City for natural area purposes; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations, in combination with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, City staff has determined that the appropriation of the value of the donated Property, as described herein, will not cause the total amount appropriated in the City's Natural Areas Fund to exceed the current estimate of actual and anticipated revenues to be received in that fund during the fiscal year. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL. OF THE CITY OF FORT COLLINS as follows: Section 1. The Council hereby approves and authorizes the Mayor to accept a deed of conveyance of the Property for natural area purposes. Section 2. That there is hereby appropriated from unanticipated revenue in the Natural Areas Fund the sum of ONE THOUSAND TWO HUNDRED FIFTY DOLLARS ($1,250) representing the fair market value of the donated Property. Introduced, considered favorably on first reading, and ordered published this 20th day of April, A.D. 2004, and to be presented for final passage on the 4th day of May, A.D. 2004.
