HomeMy WebLinkAbout173 - 10/20/1998 - APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND TO BE USED TO UPGRADE THE CROSSING S 4 ORDINANCE NO. 173, 1998 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND TO BE USED TO UPGRADE THE CROSSING WARNING DEVICES AT NORTH LEMAY AVENUE AND BURLINGTON NORTHERN AND SANTA FE RAILROAD CROSSING WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins(the"Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year,do not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, the City Council adopted Resolution 98-134, on October 6, 1998, approving the contract between the City, the State of Colorado, and the Burlington Northern and Santa Fe Railway Company, and authorizing the City Manager to enter into an intergovernmental agreement with the Colorado State Department of Transportation(CDOT)for the receipt of federal Intermodal Surface Transportation Efficiency Act(ISTEA) funds to be used to upgrade the crossing warning devices at the North Lemay Avenue and Burlington Northern and Santa Fe Railroad Crossing(the "Project"); and WHEREAS,the estimated cost of the Project is Eighty-Two Thousand Two Hundred Thirty- Eight Dollars ($82,238); and WHEREAS, CDOT has made available to the City,ISTEA funds in the maximum amount of Ninety Thousand Seven Hundred Dollars ($90,700)to fund the Project; and WHEREAS,local funds,needed to reimburse CDOT for administering the Project, totaling Two Thousand Five Hundred Dollars($2,500)have been identified and are appropriated in the 1998 Minor Streets capital project within the Capital Projects Fund; and WHEREAS, it is the desire of the Council to appropriate the sum of$90,700 in federal ISTEA funds to be used to upgrade the crossing warning devices at North Lemay Avenue and Burlington Northern and Santa Fe Railroad Crossing. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the Minor Streets capital project in the Capital Projects Fund, the sum of NINETY THOUSAND SEVEN HUNDRED DOLLARS ($90,700) from the Colorado Department of Transportation to be used to upgrade the crossing warning devices at North Lemay Avenue and Burlington Northern and Santa Fe Railroad Crossing. Introduced and considered favorably on first reading and ord ublished this 6th day of October, A.D. 1998, and to be presented for final passage on th th y of October, A.
