OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING AN ALLEY
LOCATED IN THE ROBINSON-PIERSAL BLOCK
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate an alley located in the Robinson-Piersal block, set forth in more
particular below; and
WHEREAS, the owners and developers of the property have determined
that the dedicated north-south alley in Block 124 needs to be vacated to
conform to the development of the property as noted on the approved P.U.D.
for the Robinson-Piersal project; and
WHEREAS, the developer has agreed to pay for the costs of removal and
relocation of the sewer line, gas line and telephone poles now in the
alley; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the north-south alley located in Block 124 of the
City of Fort Collins, set out more particularly as follows, to wit:
A publicly dedicated twenty foot wide alley located in Section
12, Township 7 North, Range 69 West of the 6th P.M. , Block 124,
City of Fort Collins, Larimer County, Colorado, the centerline of
which is more particularly described as follows:
Commencing at the northwest corner of Block 124, City of Fort
Collins, Colorado, said corner also being the northwest corner of
Robinson-Piersal Plaza P.U.D. ; thence along the north line of
said Block 124 due East 150.00 feet to the True Point of
Beginning; thence due South 400.00 feet more or less to the south
line of said Block 124 and the end of the dedicated alley.

Section 2. That the foregoing vacation is conditioned upon payment by
the developer to Mountain Bell and Public Service Company of those amounts
agreed upon for the removal and/or relocation of facilities belonging to
Mountain Bell and Public Service Company which are located in the alley to
be vacated and that such payment be made in full on or before January 5,
1987.
