HomeMy WebLinkAbout202 - 12/16/1986 - SUBMITTING A PROPOSED CHARTER AMENDMENT TO A VOTE OF THE REGISTERED ELECTORS CONCERNING THE CITYS BO ORDINANCE NO. 202, 1986 OF THE COUNCIL OF THE CITY OF FORT COLLINS SUBMITTING A PROPOSED CHARTER AMENDMENT TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY OF FORT COLLINS CONCERNING THE CITY'S BOARDS AND COMMISSIONS AND ADMINISTRATIVE BRANCH WHEREAS, Article IV, Section 8 of the Charter of the City of Fort Collins provides that the Charter may be amended as provided by the laws of the State of Colorado; and WHEREAS, Section 31-2-210, C.R.S. , provides that Charter amendments may be initiated by the adoption of an ordinance by the Council submitting a proposed amendment to a vote of the qualified electors of the City of Fort Collins; and WHEREAS, the Council desires to submit certain proposed Charter amendments to the registered voters of the City at the next regular City election to be held on March 3, 1987. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. The following proposed Charter amendment shall be submitted to the registered voters of the City at the next regular City election to be held on March 3, 1987: PROPOSED CHARTER AMENDMENT NO 6 Part A. Section 5(b) of Article II of the Charter of the City is hereby amended as follows: (b)-By-erdinanee-ereate;-ehange;-t:enseiidate-and-abeiish-e#€fees; departments-ar-ageneiesy- whether-ereated--by--the--Chapter-or etherwtse;-and-to-assign-€unettens-and-duties-to-the-same-and te-any-of€ieers;-departments-er-ageneies-est;abii shed-by-this 6hartert--prov4de--thats--tpe--€enet4ens--establ4shed--4n--the Charter-#er-any-departmeet-shall-net-He-abelishedt (b) ESTABLISH, CHANGE, CONSOLIDATE OR ABOLISH ADMINISTRATIVE OFFICES, DEPARTMENTS OR AGENCIES BY ORDINANCE, UPON REPORT AND RECOMMENDATION OF THE CITY MANAGER, SO LONG AS THE ADMINISTRATIVE FUNCTIONS AND PUBLIC SERVICES ESTABLISHED BY THIS CHARTER ARE NOT ABOLISHED IN ANY SUCH REORGANIZATION. THE CITY SHALL PROVIDE FOR ALL ESSENTIAL ADMINISTRATIVE FUNCTIONS AND PUBLIC SERVICES, INCLUDING, BUT NOT LIMITED TO THE FOLLOWING: (1) FIRE SUPPRESSION AND PREVENTION (2) POLICE SERVICES i 1 (3) FINANCE AND RECORDKEEPING (4) ELECTRIC LIGHT AND POWER (5) WATER SUPPLY AND WASTEWATER SERVICES (6) STREET MAINTENANCE (7) STORM DRAINAGE (8) PLANNING AND ZONING Part B. Sections 4(b) , 5 and 6 of Article III of the Charter of the City are hereby repealed and the remainder of Section 4 of said article is amended as follows: ARTICLE III Section 4. Removal of City Manager. The Council shall appoint the City Manager for an indefinite term and he-may-be-removed-by-any-of-the-#ellew4ng-methedse-(a) MAY REMOVE A CITY MANAGER BY majority vote of the Council members. If A CITY MANAGER IS removed by this method, at least thirty days before such removal shall takeS effect, the Council shall by majority vote of its members adopt a resolution stating the reasons for his THE removal , which resolution may ALSO provide for his INTERIM suspension. Upon such removal or suspension by this method the Council shall cause to be paid to the City Manager any unpaid balance of his OR HER salary for the current month and his THE salary for the next calendar month. Section 1 of Article IV of the Charter of the City is hereby amended as follows: ARTICLE IV Section 1. Appointive boards. A-L4brary-Beard;-a-Plann4ng-and-Zen4nq-Beard;-a-Beard-of-Zeaing Appeals;-and-a--Beard--of--Eleet4ens--shall--be-appointed--by--the Council-and-shall-have-the-powers-and-duties-preser4bed-by-th4s -2- 1 Charter: The Council may by ordinance, PRESCRIBING THE POWERS AND DUTIES DELEGATED BY COUNCIL, create additional boards AND COMMISSIONS, the members of which shall serve without pay. Members of boards AND COMMISSIONS shall serve for four years or until their successors are appointed. Initial appointments shall specify the term of office for each individual in order to achieve overlapping of tenure. THE COUNCIL MAY APPOINT ALTERNATE MEMBERS WHO MAY BE AUTHORIZED TO VOTE WHEN SERVING IN THE ABSENCE OF A REGULAR MEMBER. All members shall be subject to removal by the Council . ANY VACANCY DURING THE UNEXPIRED TERM OF ANY MEMBER SHALL BE FILLED BY THE COUNCIL FOR THE REMAINDER OF THE TERM. All--boards--shall--eheese--their--ewn--off ieers: EACH BOARD AND COMMISSION SHALL CHOOSE ITS OWN OFFICERS FROM AMONG ITS MEMBERS. THE COUNCIL MAY CHANGE ANY OR ALL OF THE POWERS, DUTIES AND PROCEDURES OF ANY BOARD OR COMMISSION AND MAY ABOLISH ANY BOARD OR COMMISSION WHICH IS NOT REQUIRED BY THIS CHARTER OR LAW. Part D. Section 2 of Article IV of the Charter of the City is hereby amended as follows: ARTICLE IV Section 2. Administrative branch. The administrative branch of the City government shall be composed of the offices, departments and agencies established by this-Charter-and-saeh-ethers-as-may-be-established-by ordinance upon REPORT AND recommendation of the city manager. ADMINISTRATIVE FUNCTIONS AND DUTIES MAY BE ASSIGNED AND DISTRIBUTED AMONG OFFICES, DEPARTMENTS OR DIVISIONS THEREOF, OR AGENCIES OF THE ADMINISTRATIVE BRANCH BY REGULATIONS ISSUED BY THE CITY MANAGER. THE CITY MANAGER SHALL HAVE POWER, WHENEVER THE INTEREST OF THE CITY REQUIRES, TO ASSIGN ANY EMPLOYEE OF ONE DEPARTMENT TO PERFORM DUTIES IN ANOTHER DEPARTMENT. Part E. Section 3 of Article IV of the Charter of the City is hereby repealed and reenacted as follows: ARTICLE IV Section 3. Direeters-e#-departments-and-ehie€s-of-divisions RESIDENCY REQUIREMENT. ANY DIRECTOR OF A DEPARTMENT OR GROUP OF DEPARTMENTS, WHENEVER -3- APPOINTED, AND ANY DIVISION HEAD APPOINTED AFTER MARCH 5, 1985, SHALL, WHILE SO EMPLOYED, BE A RESIDENT OF THE FORT COLLINS URBAN GROWTH AREA. Part F. Article XXI of the Charter of the City is hereby amended by amending the following definitions: "Department" means a major City administrative unit in-eharge-of HEADED BY a director. who-4s-directly-and-selely-responsible-te the-eity-manager: "Division" means a primary subdivision of a department in-eharge of HEADED BY a person who is directly responsible to the director of the department. and--s eeondarily--responsible--te--the-fity manager: Part G. Sections 22, 23(b) and the first paragraph of Section 23 of Article V of the Charter of the City are hereby amended as follows: ARTICLE V Section 22. Department-ereatedT-qualiiieatiens-of-direeter: FINANCIAL OFFICER. A--Department--of--Finanee--4s--hereby--created T--the--exeewtive off ieer-ef-whieh-shall-be-the-direeter-ef-finanee-who-shall-have special--knewledge--of--munieipal--aeeeuntingT--taxation;--budget making;-and-#inanee: THE CITY MANAGER SHALL APPOINT AN EXECUTIVE OFFICER OF FINANCE WHO SHALL HAVE SPECIAL KNOWLEDGE OF MUNICIPAL ACCOUNTING, TAXATION, BUDGET MAKING, AND FINANCE. SUCH OFFICER SHALL BE THE EX-OFFICIO CITY TREASURER AND HEAD THE ADMINISTRATIVE UNIT ASSIGNED THE FINANCIAL AFFAIRS OF THE CITY. Section 23. Powers and duties. The direeter-ef-#inanee FINANCIAL OFFICER shall have charge of the financial records and general and special funds of the City, and shall collect, receive, and disburse all money belonging to the City, and shall have all other duties required to administer properly the financial affairs of the City; to that end he THE FINANCIAL OFFICER shall have authority and shall be required to: (b) Advise the city manager of the budget requirements of the Department--of-finanee FINANCIAL ADMINISTRATION UNIT and furnish estimates and information concerning other departments, agencies, and boards as requested by the city manager; . . . -4- 1 Part H. Section 29 of Article V of the Charter of the City is hereby repealed and Section 30 of said article is hereby amended as follows: ARTICLE V Seetien-29:-Department-created: A-department-of-purehases-shall-be-created-and-the-head-thereef steal l--fie--the--purchasing--agent--for-all--departments-end-ether agenc4es-ef-the-64ty: Section 30. Powers and duties. THE CITY MANAGER OR DESIGNEE SHALL APPOINT A The purchasing agent WHO shall contract for, purchase, receive, distribute, and store all supplies, materials, and equipment required or used by all departments and agencies of the City, including businesses and enterprises operated by the City. The purchasing agent shall have power and be required to: (a) Establish and enforce specifications as to supplies, materials, and equipment; receive and inspect all deliveries as to quantity, quality, and condition, and refuse delivery if the same fails to conform to the specifications; (b) Cause all automobiles, trucks, and movable road and street machinery, except police patrol cars, to be marked by conspicuous means with the term "Property of the City of Fort Collins." It shall be a misdemeanor for any unauthorized person to have any City property in his OR HER possession at any time. The use of City property for private purposes is hereby prohibited. THE PURCHASING AGENT MAY BE AUTHORIZED BY ORDINANCE TO CONTRACT FOR CONTRACTUAL SERVICES NEEDED BY ANY DEPARTMENT OR AGENCY OF THE CITY. Part I. Section 15 of Article II, and Sections 6, 12, 13 and 35 of Article V of the Charter of the City are amended by substituting the term "financial officer" for the term "director of finance" and such substitution of terms shall occur wherever else in the Charter that "director of finance" appears. Part J. Section 25 of Article V of the Charter of the City is hereby amended as follows: ARTICLE V Section 25. Responsibility for funds. All money belonging to the City and in the custody of City employees shall be paid daily to the department--ef--finanee FINANCIAL OFFICER. -5- 1 1 Part K. The first paragraph of Section 6 of Article XIII of the Charter of the City is hereby repealed and reenacted with modifications as a new Section 1 for Article IX of said Charter and the remaining portion of said Article XIII, Section 6 is hereby amended as follows: ARTICLE XIII Section 6. City-may-acquire-utilities OPTION TO PURCHASE. Such valuation shall be made as provided in the grant, but shall not include any value of the franchise or right-of-way through the streets or any earning power of such property. -6- ARTICLE IX Section 1. City may acquire utilities. The council upon vote of the taxpaying electors shall have the power within or without the territorial limits of the City to construct, condemn and purchase, acquire, and lease water works, gas works, light plants, power plants, transportation systems, telephone systems, heating plants, and other public utilities local in use and extent, in whole or in part, and everything required therefor, for the use of the City and its inhabitants, and any such systems, plants, works, or ways, or any contracts in relation or in connection therewith which may exist and which the City may desire to acquire or purchase, in whole or in part, the same or any part thereof may be purchased by the City. AN ELECTION IS NOT REQUIRED FOR THE PURCHASE OF A PORTION OF A UTILITY SYSTEM WHICH IS INCLUDED IN AN AREA BEING ANNEXED TO THE CITY AND WHICH IS NOT THE SUBJECT OF AN EXISTING CITY FRANCHISE. Such public utilities acquired by the City, except water works and transportation systems, shall not be paid for out of general taxes or general obligation bonds, but shall be paid for from revenue derived from the public utility. Equipment necessary for transportation system may be acquired from the funds of the equipment fund of the city. Part M. Section 2 of Article IX of the Charter of the City is hereby repealed and reenacted as follows: ARTICLE IX. Section 2. Funet#ens-of-department: RIGHT OF ENTRY. The-Department-a€-Municipal-Publie-Utilities-shall-have-charge off (a)--The--water--and--eleetrie--plants;--all--the--distribution systems--thereof;--filtratien--plants;--reservoirs;--well s, generating---plants;--end---other--4aeilities---direetly eenneeted--therewith;--sanitary--sewer--system-and--sewage disposal--plant;-and-all--plants;--properties;-equipment; and--applianees--4neident---to--or--eenneeted--with--the operation--of--the--water;-eleetrie;-and-ether--itil-ties whether-within-er-without-the-Cityt (b)--The--designing;--eenstruetien reeenstruetien;--additien; repair;---replaeement;---maintenanee;--- upervisien;--and eperatien--e€--the--water--and--light--plants;--physieal properties;--bulldings;--and--distribution--systemst--and street--1fighting--system--and--egeipment;--sanitary--sewer system-and-disposal-plant;-and-ether-utilitiest (e)-Meter-readingst -7- (d)--The-en€orcement-ef-all-+rules;--regulat ions;-metheds;-and practices---prescribed---by---the--Eeuneil--governing--the €urnishing--and--measurement--of--the--munieipal--utility services;--including-4he--author ity-4e--diseentinue-any service---fer--fl eRpayment;--er---for--neR-maintenance--ef equipment- -connected- with- -the- -main - -supplyr - -or nen-eemplianee-by-any-custemer-with-erdinanees;-rules-and regulations-relating-te-the-departments (e) - The- records- a€- leeatiens ; -di reetion ; -depth; -and eeRnectiens- of- all - underground-and-above-ground facilities-and-equipment-of-the-department: The-director-of-the-department-shall-per€erm-such-ether-duties net-hereiR-speei€ically-set-eut-as-may-be-required-of-him-by-the eity-manager-er-by-erdinanee: The directorS and employees of the--department CITY-OWNED UTILITIES shall have authority in the necessary discharge of their duties to enter upon any lands, properties or premises, within or without the city LIMITS, for the examination or survey thereof, or for the purpose of repairing, inspecting, removing, or connecting the service, reading meters, or any other purpose whatever in connection with the water, WASTEWATER, electric, and other utilities. Part N. Section 3 of Article IX of the Charter of the City is hereby amended as follows: ARTICLE IX Section 3. Restriction on sale of water and electric property. The City shall not sell , lease, or in any manner dispose of the CITY'S water or electric utility system as a whole unless and except the proposition for such purpose shall HAS first have been approved by a vote of the electors. The provisions of this section shall not apply to the sale, lease or exchange of any part of the water or electric utility systems, which the Council , by ordinance, determines does not materially impair the viability of the particular utility system as a whole and further determines is for the benefit of the citizens of Fort Collins. The provisions of this section shall also not apply to the sale of water rights no longer useful to the City ef-Fert-Collins nor to the exchange of certain water rights for other water rights which would be more useful to the City. ef-Fert-Cellias: Part 0. Section 7 of Article IX of the Charter of the City is hereby amended as follows: -8- ARTICLE IX Section 7. Water Board. There shall be a Water Board which shall consist of such NUMBER of members as set by the City Council not to exceed ten. All members of the Water Board shall serve without compensation and shall be appointed by the City Council . To advise the Council on all matters pertaining to the acquisition, control and disposition of water rights. B. To advise the Council in all matters pertaining to the municipal water works AND WASTEWATER TREATMENT systems. C. To perform such other duties and functions and have such other powers as may be provided by ordinance of the City Council . Part P. Section 9 of Article II of the Charter is hereby amended as follows: ARTICLE II Section 9. Ordinance codification. The Council shall cause the permanent ordinances to be codified. Such codification may be of the entire body of permanent ordinances or of the ordinances on some particular subject and may be re-enacted by the Council or authenticated in such other manner as may be designated by ordinance. No codification ordinance shall be invalid on the ground that it deals with more than one subject. The first codification shall be completed within five years of the effective date of this Charter and subsequent codifications shall be made thereafter as deemed necessary by the Council , and all permanent ordinances adopted thereafter shall be codified yearly AT LEAST ONCE A YEAR. Part Q. Section 14 of Article II of the Charter of the City is hereby amended as follows: ARTICLE II Section 14. Licenses, permits. The Council may provide for licenses and permits, and fees therefor, for regulatory purposes. The Council shall hear-and -9- decide PROVIDE AN ADMINISTRATIVE PROCEDURE FOR THE HEARING AND DETERMINATION OF appeals relating to issuance, suspension or revocation of SUCH licenses and permits. THE COUNCIL ITSELF MAY HEAR AND DECIDE APPEALS. Part R. Section 2 of Article XIV and the definition of "misdemeanor" in Article XXI of the Charter of the City is hereby amended as follows: ARTICLE XIV Section 2. Penalty for violation. The Council shall provide for enforcement of its ordinances. No-4Ines-er--4mprisomments--shall-exceed--the--fellewing--4imitst fines--three--hundred--dellarst--4mprlsenment;-Mine€y-,daysi-er-a combination--of--both-f 4ne-and-4mpr4senment-within-*he-designated limits THE MAXIMUM PENALTY FOR A VIOLATION OF THE ORDINANCES OF THE CITY SHALL BE SET BY THE COUNCIL BY ORDINANCE. The-Gedneil-is not-to-be-otherwise-limited-in-its-punitive-measures: ARTICLE XXI. "Misdemeanor" means a violation of this Charter or of any city ordinance SO DESIGNATED, and it shall not have the meaning attached to it in the criminal statutes of the State of Colorado. Part S. Article XII is hereby repealed in its entirety and Section 3 thereof reenacted as Section 15 of Article IV as follows: ARTICLE IV Section 15. Improvement districts. A public work or improvement, the costs of which in whole or in part are to be assessed by the City, may be initiated by the Council on recommendation of the direeter-e€-public-works CITY MANAGER, or on petition of property owners in such number and in such form as may be prescribed by ordinance. The Council shall by ordinance prescribe the method of making such improvements and the assessments for their cost.
