HomeMy WebLinkAbout197 - 12/16/1986 - SUBMITTING A PROPOSED CHARTER AMENDMENT TO A VOTE OF THE REGISTERED ELECTORS CONCERNING ELECTION OF s i ORDINANCE NO. 197, 1986 OF THE COUNCIL OF THE CITY OF FORT COLLINS SUBMITTING A PROPOSED CHARTER AMENDMENT TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY OF FORT COLLINS CONCERNING ELECTION OF FOUR COUNCIL MEMBERS BY DISTRICTS OF THE CITY WHEREAS, Article IV, Section 8 of the Charter of the City of Fort Collins provides that the Charter may be amended as provided by the laws of the State of Colorado; and WHEREAS, Section 31-2-210, C.R.S. , provides that Charter amendments may be initiated by the adoption of an ordinance by the Council submitting a proposed amendment to a vote of the qualified electors of the City of Fort Collins; and WHEREAS, the Council desires to submit certain proposed Charter amendments to the registered voters of the City at the next regular City election to be held on March 3, 1987. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. The following proposed Charter amendment shall be submitted to the registered voters of the City at the next regular City election to be held on March 3, 1987: PROPOSED CHARTER AMENDMENT NO 1 Part A. Section 1 of Article II of the Charter of the City is hereby amended to read as follows: Section 1 . Membership; TERMS. (a) The council shall CONSIST OF have seven (7) members elected as herein provided. (b) Three (3) of such council members shall be nominated and elected from the City at large. The remaining four (4) members shall be nominated by--districts--4n--the--City establi shed--by-QrdinaRee-ef-the-Gity-Ceaneil and elected by DISTRICTS. the-Eity-at-4arge-.--Cemmeneing-with-the-general eleetien-4n-1977;-the-City-Ceeneil-shall;-by-Ord4nanee; (C) At least six (6) months before any election at which council members will be elected from districts, divide-the-City-irate feur-{4)-distr4ets; THE CITY SHALL BE DIVIDED, BY ORDINANCE, INTO FOUR DISTRICTS, each consisting of approximately the same number of REGISTERED electors, and each district representing one (1) continuous, reasonably compact unit. BEGINNING IN 1989, one (1) council member shall be elected from each OF THE FOUR districts so established by the ELECTORS OF THE RESPECTIVE DISTRICT. Each regular biannual City election shall alternate between selecting "at-large" members of the Council and SELECTING members nominated AND ELECTED BY from districts. The term of members of the Council shall begin at 10:00 o'clock a.m. on the first Tuesday after the second Monday in March of the year in which they shall--have-been ARE elected. provided that In the event a run-off election is required pursuant to Article XVI, Section 2.2 of this Charter, the term of all members of the City Council shall begin on the first Tuesday after the second Monday in April of the year in which they shall-have-been ARE elected. Part B. In the event that Proposed Charter Amendment No. 5, concerning elections and repealing run-off requirements, is adopted by the electors, Section 1(d) of Article II shall be further amended by deleting the last sentence of the paragraph concerning the commencement date of council terms after run-off. Part C. Section 12 of Article XVI of the Charter of the City is hereby amended as follows: Section 12. Canvass of vote. The Board of Elections shall meet as a canvassing board on the third day after every City election and canvass the vote. The board shall determine the total number of legal votes cast for each candidate and measure voted upon, and file a certificate with the city clerk declaring the results of the election. The candidates receiving the highest number of votes so far as there are full-regular terms to be filled FOR -2- AT-LARGE COUNCIL OFFICE shall be declared elected to those terms. If--there-4s-a-vaeaney--term-er--terms--to-be-filled, then--the-aand4date-ar--eand4dates--hav4ng--the--next--h4ghest number-af--rotes--se--€ar-as--there--are--vaeaney-ferns--te--be €filled-shall-be-declared-elected: THE CANDIDATE RECEIVING THE HIGHEST NUMBER OF VOTES FOR A DISTRICT COUNCIL OFFICE SHALL BE DECLARED ELECTED TO THAT OFFICE. In event of a tie, THERE SHALL BE A RECOUNT OF THE BALLOTS CAST FOR THE TIED POSITION, AND IF THE VOTE REMAINS TIED UPON THE RECOUNT, the selection shall be made by the Board of Elections by lot after notice to the candidates affected. Part D. Capital letters indicate new or substituted language; dashes through words indicate deletions from existing provisions and such material is not a part of the final charter language. Section 2. The following ballot language is hereby adopted for submitting Proposed Charter Amendment No. 1 to the voters at said election: PROPOSED CHARTER AMENDMENT NO. 1 Amendments to Articles II and XVI of the Charter of the City of Fort Collins which would require four (4) members of the City Council to be nominated and elected by districts of the City beginning in 1989 and the remaining three (3) members of the City Council to be nominated and elected by the City at-large, and which would require an automatic recount of the vote in the event of a tie vote, and which would further repeal Article II, Section 1(c) concerning the regular city elections in 1973 and 1975.
