OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING THE ALLEY THROUGH A PORTION OF THE FREY SUBDIVISION
IN THE CITY OF FORT COLLINS
WHEREAS, the Council of the City of Fort Collins has been petitioned to
vacate the alley through a portion of the Frey Subdivision, set forth in
more particular below; and
WHEREAS, the alley is not currently used by utilities or for public
access nor is there any use planned for the future; and
WHEREAS, all property owners have indicated in writing their request
for vacation and have agreed to maintain the property after formal vacation
by the City; and
WHEREAS, all utilities have been contacted and indicate no problems
with the vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that alley behind Lots 8, 9, 10, 11, 19, 20, 21, and 22 of the Frey
Subdivision, set out more particularly as follows, to wit:
A portion of the alley in Frey Subdivision, City of Fort
Collins, County of Larimer, State of Colorado, according to
the recorded plat thereof, more particularly described as
follows, to wit: Beginning at the Northwest corner of Lot 19
of the Frey Subdivision and thence West approximately 20
feet to the Northeast corner of Lot 11, thence South a
distance of approximately 239.2 feet to the Southeast corner
of Lot 8; thence East a distance of approximately 20 feet to
the Southwest corner of Lot 22; thence North a distance of
approximately 239.1 feet to the true point of beginning.
be, and the same hereby is, vacated, abated and abolished.
Introduced, considered favorably on first reading, and ordered
published this 4th day of March, A.D. 1986, and to be presented for final
passage on the 18th day of March, A.D. 1986.
