HomeMy WebLinkAbout032 - 04/01/1986 - ANNEXING PROPERTY KNOWN AS THE SEVEN SPRINGS/HAHN ANNEXATION ORDINANCE NO. 32 , 1986 OF THE COUNCIL OF THE CITY OF FORT COLLINS ANNEXING PROPERTY KNOWN AS THE SEVEN SPRINGS/HAHN ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO WHEREAS, Article II, Section 30 of the Constitution of the State of Colorado requires that one of the following conditions be met before an unincorporated area be annexed to a municipality: 1. The question of annexation be submitted to a vote of the landowners and registered electors of the area to be annexed and the majority of such persons voting, vote in favor of annexation; or 2. The annexing municipality receive a petition for annexation signed by more than 50% of the landowners in the area who own more than 50% of the land; or 3. The area to be annexed be entirely surrounded by or be solely owned by the annexing municipality; and WHEREAS, 100% of the landowners in the Seven Springs/Hahn Annexation area have signed a petition for annexation; and WHEREAS, not less than one-sixth (1/6th) of the perimeter of the area to be annexed is contiguous with the City of Fort Collins and a community of interest exists between the territory to be annexed and the City of Fort Collins; and the territory to be annexed is urban or will be urbanized in the near future; and such territory is integrated or is capable of being integrated with the City of Fort Collins; and WHEREAS, no election is required and no additional terms and conditions are to be imposed in connection with this annexation; and WHEREAS, the Council has found and determined and does hereby find and determine that said petition is in substantial compliance with the annexation laws of the State of Colorado and that the territory is eligible for annexation, and the City Council desires to annex the same to the City of Fort Collins; and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That the following described property A tract of land located in the Northwest quarter and in the South half of Section 3, and in the East half of Section 4, all being in Township 6 North, Range 69 West, of the 6th P.M. of Larimer County, Colorado, being more particularly described as follows: Considering the South line of the said South half of Section 3 as bearing South 90°00'00" East and with all bearings contained herein relative thereto: Commencing at the Southwest corner of said Section 3 being the True Point of Beginning; thence along the said South line, South 90°00'00" East 940.02 feet to a point which is 1700.41 feet West of the South quarter corner of said Section 3 (as measured along the said South line) ; thence North 00°00'00" East 100.00 feet to a line which is 100.00 feet (measured at right angles) North of and parallel with the said South line of Section 3; thence along said parallel line, North 90000'00" East 4244.95 feet to a line which is 100.00 feet (measured at right angles) West of and parallel with the East line of the said South half of Section 3; thence along said parallel line, North 00°01' 37" West 2074.95 feet to the South line of the Plat of The Ridge, a plat of record with the Clerk and Recorder of said Larimer County; thence along the said South line of The Ridge, and along the South line of the North 30 acres of the Southwest quarter of said Section 3, South 89044'03" West 5154.05 feet to the East right-of-way of South Taft Hill Road (County Road 19) ; thence along said East right-of-way, North 00°UO'00" East 3149.54 to the North line of the said Northwest quarter of Section 3; thence along said North line, North 89054'39" West 30.00 feet to the Northwest corner of said Section 3; thence along the boundary of the Plat of Seven Springs Ranch P.U.D. - First Filing, a plat of record with the said Clerk and Recorder of Larimer County, the following five (5) courses and distances (1) South 89°41 '36" West 2690.91 feet; (2) South 00°30'21" East 5322.21 feet; (3) North 89°13'28" East 1918.13 feet; (4) North 00000'00" East 300.00 feet; (5) North 89° 13'28" East 696.00 feet to the West right-of-way of the said South Taft Hill Road; thence along said West right-of-way, South 00°00'00" West 300.00 feet to the South line of the said East half of Section 4; thence along said South line, North 89013'28" East 30.00 feet to the True Point of Beginning. The above described tract contains 570.31 acres and is subject to all easements and rights-of-way now existing or of record. be, and it hereby is, annexed to the City of Fort Collins and made a part of said City, to be known as the Seven Springs/Hahn Annexation. Section 2. That in annexing said territory to the City of Fort Collins, the City of Fort Collins does not assume any obligation respecting the construction of water mains, sewer lines, gas mains, electric service lines, streets or any other services or utilities in connection with the territory hereby annexed except as may be provided by the ordinances of the City of Fort Collins. Section 3. That within ninety (90) days from the date this Ordinance becomes effective, no building permit shall be issued for any of the lands herein described unless said lands have been zoned under the zoning ordi- nances of the City. Introduced, considered favorably on first reading, and ordered published this 4th day of March, A.D. 1986, and to be presented for final passage on the 1st day of April , A.D. 1986.
