OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE SALE OF REAL PROPERTY DESCRIBED AS
WTP HOUSE AT 4316 LAPORTE AVENUE
WHEREAS, the City has issued a request for bids seeking buyers for a residential house,
known as the WTP House, on the site of Water Treatment Plant 42 at 4316 LaPorte Avenue; and
WHEREAS, in response thereto, the City has received one acceptable bid from A-One
Housemoving in the amount of Five Thousand One Dollars ($5,001) for the WTP House; and
WHEREAS, under Section 23-111(a) of the Code, the Council is authorized to sell real
property owned in the name of the City,provided it first finds the sale is in the best interest of the
City; and
WHEREAS, under Section 23-11 l(b) of the Code, with respect to real property which is a
part of the City's water or utility systems, the City Council must also find that the disposition will
not materially impair the viability of the particular utility system as a whole and that it will be for
the benefit of the citizens of the city.
NOW, THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the sale of the WTP House to A-One Housemoving for the sum of FIVE
THOUSAND ONE DOLLARS ($5,001)is in the best interests of the City and will not materially
impair the viability of the water utility,and that said amount is the best price obtainable by the City
for the WTP House and represents the fair market value thereof.
Section 2. That the Mayor be, and hereby is, authorized to execute such agreements of
sale and documents of conveyance as are necessary for the City to sell and convey the Property on
the terms and conditions described above.
