HomeMy WebLinkAbout018 - 02/17/2004 - APPROPRIATING UNANTICIPATED REVENUE IN THE TRANSPORTATION SERVICES FUND AND AUTHORIZING THE TRANSFER ORDINANCE NO. 018, 2004 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE TRANSPORTATION SERVICES FUND AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS FOR THE PURPOSE OF CONSTRUCTING BICYCLE LANE AND STREETSCAPE IMPROVEMENTS ALONG WEST ELIZABETH STREET BETWEEN CITY PARK AVENUE AND SHIELDS STREET WHEREAS, on August 20, 2002, City Council adopted Ordinance No. 097, 2002, appropriating$307,000,representing Congestion Mitigation&AirQuality(CMAQ)funds from the Colorado Department of Transportation ($246,762) and City matching funds ($60,238), to be used to fund bicycle improvements along West Elizabeth Street between City Park Avenue and Shields Street, and thereby mitigate traffic impacts resulting from the inability of the current roadway to safely accommodate both bicycles and automobiles; and WHEREAS, the Colorado Department of Transportation (CDOT) has awarded the City $176,029 in federal Surface Transportation Program (STP) Metro grant funds, requiring a local match to be provided by the City in the amount of $42,971, to be used with the aforementioned CMAQ funds and City matching funds to construct safer bike lanes, pedestrian crossings, and streetscape improvements along West Elizabeth Street between City Park Avenue and Shields Street (the "Project"); and WHEREAS, local matching funds required in order for the City to receive the STP funds, totaling$42,971,have been identified and are available in the form of existing appropriations in the Transportation Services Fund - Pavement Management Program; and WHEREAS,the Project improvements will include relocating the existing curb to widen and install seven-foot bike lanes, constructing center medians with a refuge area for a mid-block pedestrian crossing, improved pedestrian crossings at intersections, landscaping, and upgrading existing utilities; and WHEREAS, the Project, scheduled to begin in May 2004, is being planned in conjunction with Pedestrian Plan improvements to the sidewalks, and will be constructed during the Pavement Management Program's scheduled street reconstruction of West Elizabeth during the Summer of 2004; and WHEREAS, the Project is estimated to be completed by October 2004; and WHEREAS, Article V,Section 9,of the Charter of the City of Fort Collins permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,Article V,Section 10, of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project, provided that the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, City staff has determined that the appropriation of the federal Surface Transportation Metro funds as described herein will not cause the total amount appropriated in the Transportation Services Fund - West Elizabeth Bike Lane project budget to exceed the current estimate of actual and anticipated revenues to be received during any fiscal year; and WHEREAS, it is the desire of the Council to appropriate the sum of$176,029 in Colorado Department of Transportation federal Surface Transportation Metro funds in the Transportation Services Fund- West Elizabeth Bike Lane project, and authorize the transfer of$42,971 in existing appropriations in the Transportation Services Fund - Pavement Management Program to the Transportation Services Fund - West Elizabeth Bike Lane project to construct safer bike lanes, pedestrian crossings,and streetscape improvements along West Elizabeth Street between City Park Avenue and Shields Street. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from unanticipated revenue in the Transportation Services Fund-West Elizabeth Bike Lane project,the sum of ONE HUNDRED SEVENTY-SIX THOUSAND TWENTY-NINE DOLLARS ($176,029), upon receipt, from the Colorado Department of Transportation,be used to construct safer bike lanes,pedestrian crossings, and streetscape improvements along West Elizabeth Street between City Park Avenue and Shields Street. Section2. That the unexpended appropriated amount of FORTY-TWO THOUSAND NINE HUNDRED SEVENTY-ONE DOLLARS ($42,971) is hereby authorized for transfer from the Transportation Services Fund-Pavement Management Program to the Transportation Services Fund - West Elizabeth Bike Lane project to construct safer bike lanes, pedestrian crossings, and streetscape improvements along West Elizabeth Street between City Park Avenue and Shields Street. Introduced and considered favorably on first reading and ordered published this 3rd day of February,A.D. 2004, and to be presented for final passage on the 17th of February, A.D. 2004.
