OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING THE CODE OF THE CITY OF FORT COLLINS
EXEMPTING THE DOWNTOWN DEVELOPMENT AUTHORITY AND
THE FORT COLLINS HOUSING AUTHORITY FROM THE
CONFLICT OF INTEREST PROVISIONS OF THE CITY CHARTER
WHEREAS,on April 8, 1997,the electorate of the City approved certain amendments to the
City Charter; and
WHEREAS, one of such amendments was an amendment to the definition of`officer or
employee" as contained in Article IV, Section 9 of the Charter, which section pertains to conflicts
of interest; and
WHEREAS, as amended, the definition of an "officer or employee"includes a member of
any authority, board, committee or commission of the City, other than an authority that is: (1)
established under the provisions of the Colorado Revised Statutes, (2) governed by state statutory
rules of ethical conduct,and(3)expressly exempted from the provisions of said Article by ordinance
of the City Council; and
WHEREAS,the Downtown Development Authority and the Fort Collins Housing Authority
are established under the provisions of the Colorado Revised Statutes and are governed by state
statutory rules of ethical conduct; and
WHEREAS, the City Council believes that the state statutory rules of ethical conduct
adequately safeguard the public interest with regard to conflicts of interest of officers or employees
of such authorities, and that the additional application of the City's rules of ethical conduct may be
confusing and, under certain circumstances,may unduly constrain the operations of said authorities,
given the nature of the composition of their boards and their duties and responsibilities; and
WHEREAS, for the foregoing reasons,the City Council believes that it would be in the best
interests of the City to expressly exempt the officers or employees of the Downtown Development
Authority and Fort Collins Housing Authority from the provisions of Article IV, Section 9 of the
City Charter.
NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, as follows:
Section 1. That Section 2-219 of the City Code is hereby amended so as to read in its
entirety as follows,with the existing provisions of Section 2-219 and 2-220 to be numbered as 2-220
and 2-221 respectively.
Sec. 2-219. Conflicts of Interest.
The officers and employees of the Authority shall be governed by the applicable state
statutory rules of ethical conduct and said persons shall be expressly exempted from
the provisions of Article IV, Section 9 of the City Charter.
Section 2. That Section 2-248 of the City Code is hereby amended so as to read in its
entirety as follows, with the existing provisions of Section 2-248 to be renumbered as 2-249.
Sec. 2-248. Conflicts of Interest.
The officers and employees of the Authority shall be governed by the applicable state
statutory rules of ethical conduct and said persons shall be expressly exempted from
the provisions of Article IV, Section 9 of the City Charter.
Introduced, considered favorably on first reading, and ordered published this 17th day of
June, A.D. 1997, and to be presented for final passage on the 1 st day of July, A.D. 1997.
