ORDINANCE NO. 167, 1995 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING A PORTION OF STREET RIGHT-OF-WAY FOR TROUTMAN PARKWAY AND RETAINING THE SAME FOR UTILITY EASEMENT PURPOSES WHEREAS, the southwest corner of the intersection of Troutman Parkway and South College Avenue has been reconstructed with recent land development and the construction of a southbound right turn lane on South College Avenue; and WHEREAS,said right turn lane is a component of the South College Avenue Access Control Plan adopted by the City and the Colorado Department of Transportation in 1989; and WHEREAS,the construction of the right turn lane and the reconstruction of the southwest corner of the intersection of Troutman Parkway and South College Avenue was required to conform to the provisions of the South College Avenue Access Control Plan and the design standards of the State Highway Access Code; and WHEREAS, said reconstruction has resulted in excess right-of-way at the southwest corner of Troutman Parkway and South College Avenue; and WHEREAS, said right-of-way,more particularly described below, is no longer necessary or desirable to retain and the vacation of the same will result in a right-of-way configuration which is consistent with the new curb line; and WHEREAS, the area of right-of-way proposed for vacation will be retained for utility easement purposes; and WHEREAS, all public and private utility agencies have been notified of the proposed vacation and report no objection; and WHEREAS,the rights of the residents of the City of Fort Collins will not be prejudiced or injured by the vacation of said right-of-way. NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the portion of right-of-way for Troutman Parkway more particularly described as follows, to wit: That portion of Troutman Parkway of Fossil Creek Commercial Plaza, City of Fort Collins, Larimer County, Colorado located in the Southeast 1/4 of Section 35, Township 7 North, Range 69 West of the 6th P.M., Larimer County, Colorado more particularly described as follows: Commencing at the northwest corner of Lot 2, said Fossil Creek Commercial Plaza, Thence along the north line of said Lot 2 South 89°47'04” East 125.00 feet to the beginning of a tangent curve to the right having a central angle of 55°53'51" and a radius of 75.00 feet and the TRUE POINT OF BEGINNING; Thence continuing along said north line of Lot 2 and along the arc of said curve southeasterly 73.17 feet to the end of said curve; Thence non- tangent and non-radial from said curve North 04°01'14" East 16.99 feet to the beginning of a tangent curve to the left having a central angle of 93°48'18" and a radius of 15.00 feet; Thence along the arc of said curve northwesterly 24.56 feet to the end of said curve;Thence tangent from said curve North 89°47'04" West 48.26 feet to the TRUE POINT OF BEGINNING. Said portion contains 588 square feet more or less. be,and the same hereby is,vacated,abated,and abolished;RETAINING,HOWEVER,THE SAME UNTO THE CITY OF FORT COLLINS for utility easement purposes.
