FO ORDINANCE NO. 48, 1999 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY TO GRANT A NON-EXCLUSIVE EASEMENT ACROSS MEADOW SPRINGS RANCH TO WILLIAMS COMMUNICATIONS, INC. FOR INSTALLATION AND MAINTENANCE OF FIBER OPTIC CABLE WHEREAS, the City of Fort Collins (the "City") is the owner of the property known as Meadow Springs Ranch in Latimer County, Colorado ("the Ranch"); and WHEREAS, the Cities Service Gas Company has acquired a 50-foot wide easement across the Ranch for installation of a natural gas pipeline recorded in Book 908 at Reception No. 182993, in the Weld County Clerk and Recorder Office(the "Pipeline Easement"); and WHEREAS, Williams Communications, Inc. has requested a 10-foot wide non-exclusive easement(having an area of.51 acres)to be located within the boundaries of the Pipeline Easement, and subject to the Pipeline Easement, for installation and maintenance of fiber optic cable, which easement is described on Exhibit "A" attached hereto and incorporated herein by reference (the "Fiber Optic Easement"); and WHEREAS, the estimated value of the Fiber Optic Easement is $2,254; and WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized to sell, convey or otherwise dispose of real property owned by the City, provided the Council first finds by ordinance that any sale or disposition of real property owned by the City will not materially impair the viability of the City's utility system as a whole if the property is part of the system, that it will be for the benefit of the City's citizens, and that the sale is in the best interests of the City of Fort Collins. NOW, THEREFORE, BE IT ORDAINED BY fHE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the above described sale and conveyance of the Fiber Optic Easement will not materially impair the viability of the City's utility as a whole,will be for the benefit of the City's citizens, and it is in the best interests of the City. Section 2. That the Mayor is authorized to execute such documents of conveyance as are necessary to convey the Fiber Optic Easement interest to Williams Communications, Inc.
