OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING THE TERMS OF THE SUBLEASE AGREEMENT WITH
THE STATE BOARD OF AGRICULTURE
WHEREAS,the City is presently leasing office space at 405 Canyon Avenue,Fort Collins,
Colorado,pursuant to a lease agreement entered into on December 1, 1994,between the City and
the owners of the property, Claire and Madge Goddard; and
WHEREAS, the City is subleasing a portion of 405 Canyon Avenue to Retired Senior
Volunteer Program(RSVP); and
WHEREAS, RSVP has requested that its lease be terminated sixty(60)days prior to the end
of the original term; and
WHEREAS, the State Board of Agriculture wishes to sublease from the City 363 square feet
of the space currently leased by RSVP at 405 Canyon Avenue; and
WHEREAS,under the terms of the new sublease agreement,the annual rent paid to the City
will be$5,227,based upon the same terms and conditions as contained in the City's lease with Clair
and Madge Goddard; and
WHEREAS, under Section 23-114 of the Code of the City of Fort Collins, the Council is
authorized to sublease any and all interests in real property leased in the name of the City, provided
that Council first finds that the sublease is in the best interests of the City.
NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Council hereby approves the terms and conditions of the proposed sublease
agreement between the City and the State Board of Agriculture,which terms include an initial rental
term of one year with the option to extend for four additional one-year terms, contingent upon the
annual appropriation of funds sufficient to meet the State Board of Agriculture's obligations under
the sublease agreement.
