HomeMy WebLinkAbout030 - 03/19/1996 - APPROPRIATING UNANTICIPATED REVENUE IN THE CONSERVATION TRUST FUND AND UTHORIZING THE TRANSFER OF E ORDINANCE NO. 30, 1996 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE CONSERVATION TRUST FUND AND AUTHORIZING THE TRANSFER OF EXISTING APPROPRIATIONS FOR THE POUDRE RIVER IMPLEMENTATION PLAN PROJECT WHEREAS, Article V, Section 14, of the Charter of the City of Fort Collins (the "Charter") authorizes the Council to appropriate unanticipated revenues which are the result of new revenue sources at any time during the year in which such revenue is received; and WHEREAS, the City Council passed Resolution 95-127, on September 5, 1995 authorizing the Mayor to enter into an intergovernmental agreement with the State Board of Great Outdoors Colorado Trust Fund for the receipt of Great Outdoors ("GO")Colorado Grant funds to help provide funding for the Poudre River Implementation Plan Project(the "Project"); and WHEREAS, the Project involves the study of gravel mining operations along the Poudre River with the goal of creating an implementation plan involving land acquisition, gravel mining reclamation, water augmentation, and ways to enhance wildlife, historical, educational, and recreational opportunities along the Poudre River from Overland Trail Road to Interstate 25; and WHEREAS, according to the intergovernmental agreement between the City and the State Board of Great Outdoors Colorado Trust Fund, the City will receive $45,000 in GO Colorado grant funds to help fund the Project; and WHEREAS, the total estimated cost of the Project is $100,000, requiring City matching funds totaling $55,000, to be used with the GO Colorado grant funds for the Project; and WHEREAS, sources of matching funds were identified in Resolution 95-127, and the actual local matching funds needed for the project have been appropriated as part of the 1996 budget as follows: Conservation Trust Fund- Other Open Space Project $20,000 Natural Areas Capital Projects Fund -Natural Areas Capital Project 35,000 Total $55,000 WHEREAS, Conservation Trust Fund monies are received from Colorado State Lottery proceeds pursuant to state statute and are available for the acquisition,development and maintenance of interests in land and water; for park or recreation purposes;for all types of open space, including but not limited to floodplains, greenbelts, agricultural lands, or scenic areas; and for any scientific, historic, scenic, recreational, aesthetic, or similar purpose; and WHEREAS,funds from the Natural Areas Capital Projects Fund are available for acquisition of land for natural areas, or water rights; maintenance of natural areas acquired; construction of parking, trails, or other public access to natural areas; providing interpretive or educational features for areas; restoring or enhancing habitat of natural areas; promoting public/private partnerships to protect natural areas; and providing research to guide natural area conservation; and WHEREAS, Article V, Section 14 of the Charter authorizes the City Council to transfer by ordinance any unexpended appropriated amounts or portion thereof from one fund to another upon the recommendation of the City Manager,provided that the purpose for which the transferred funds are to be expended remains unchanged or the purpose for which the funds were originally appropriated no longer exists; and WHEREAS,it is the desire of the Council to appropriate the sum of$45,000 in GO Colorado Grant funds and to authorize the transfer of$55,000 in local matching funds in order to proceed with the project. NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from unanticipated revenue in the Conservation Trust Fund, the sum of FORTY-FIVE THOUSAND DOLLARS ($45,000) from the Great Outdoors Colorado Trust Fund to be used for the Poudre River Implementation Plan Project. Section 2. That the unexpended appropriated amount of TWENTY THOUSAND DOLLARS ($20,000) be authorized for transfer from the Other Open Space project within the Conservation Trust Fund to the Poudre River Implementation Plan Project within the Conservation Trust Fund. Section 3. That the unexpended appropriated amount of THIRTY-FIVE THOUSAND DOLLARS ($35,000)be authorized for transfer from the Natural Areas Capital Projects Fund to the Conservation Trust Fund, Poudre River Implementation Plan Project.
