OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING CHAPTER 5 OF THE CITY CODE TO
ALLOW COUNCIL TO CONSIDER APPROVAL OF
DEVELOPMENT IMPACT FEE REBATE REQUESTS FROM
PROJECTS LOCATED OUTSIDE THE CITY LIMITS
WHEREAS, on October 4, 1994, the City Council passed Ordinance No. 145, 1994,
amending Chapter 5 of the City Code by the addition of a new Article IX permitting the rebate of
City development impact fees for the purpose of promoting affordable housing; and
WHEREAS, Section 5-356 of the City Code authorizes the City Manager to develop
administrative regulations for the rebate program; and
WHEREAS, on October 4, 1994, the Council also passed Resolution 94-167 adopting the
administrative regulations for the Rebate Program; and
WHEREAS, Section 5-355 of City Code states that the purpose of the rebate program is for
"the provision of affordable housing for low income citizens of the city"; and
WHEREAS, the administrative regulations of the Rebate Program include a Program
Requirement that "all units must be located within the City limits of Fort Collins unless otherwise
authored by the Council"; and
WHEREAS,the wording between the City Code and the Administrative Guidelines regarding
out-of-city rebate requests should be reconciled; and
WHEREAS,the Council has determined that the interests of the City can best be served by
authorizing, under certain criteria, the granting of development fee rebates for affordable housing
provided outside the City; and
WHEREAS,on January 16, 1996,the Council adopted Resolution 96-7 which added criteria
to the administrative regulations establishing the conditions under which out-of-city rebate requests
will be evaluated.
WHEREAS, the Council has determined that, under the criteria established pursuant to
Resolution 96-7, such rebates would benefit the health, safety and welfare of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that Chapter 5, Section 355 of the Code of the City is hereby amended to read as follows:
Sec. 355. Purpose.
The general purpose of this article is to encourage the provision of
affordable housing for low income citizens of the city. The rebates
authorized pursuant to this Article shall be available only for units located
within the city limits of Fort Collins, unless the City Council finds, by
resolution, that it would be in the best interests of the City to grant a rebate
of fees under this Article to a housing project located outside the city, and
that the project for which the rebate is requested fully complies with all
applicable criteria and requirements contained in the administrative
regulations established pursuant to Section 5-356 of this Article.
