OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING PORTIONS OF THE STREET RIGHT-OF-WAY
SYSTEM IN THE RIDGE P.U.D.
WHEREAS,The Ridge P.U.D.contains a 60 foot right-of-way for a street that intersects with
Regency Drive; and
WHEREAS,this right-of-way was originally dedicated for potential vehicular access, and
has since been identified for pedestrian access only between The Ridge P.U.D. and Westbury P.U.D.;
and
WHEREAS, only 12 feet of right-of-way is necessary for the pedestrian access, leaving a
remaining 48 feet no longer necessary for the desired access,which unneeded portion is described
on Exhibit"A", attached hereto and incorporated herein by this reference (the "Regency Right-of-
Way Vacated Portion"); and
WHEREAS,The Ridge P.U.D.has also previously dedicated a 60 foot wide right-of-way for
potential vehicular access linking The Ridge P.U.D.to the Cathy Fromme Prairie(the"Ridge Right-
of-Way"),described on Exhibit`B",attached hereto and incorporated herein by this reference; and
WHEREAS,The Ridge Homeowners Association has requested that the Ridge Right of Way
be vacated as no longer necessary, and has offered to grant to the City a 15 foot easement
approximately 500 feet to the east; and
WHEREAS, the City staff agrees that such a vacation is appropriate, contingent upon The
Ridge Homeowners Association granting to the City a 15 foot easement for pedestrian access and
utilities;
WHEREAS,the grant of easement for the pedestrian access was accepted by the Council as
a Routine Grant of Easement on February 20, 1996; and
WHEREAS, it is necessary and desirable to remove the portions of the rights-of-way that
are no longer in use and vacate the rights-of-way for said portions; and
WHEREAS,all public and private utility agencies and the Poudre Fire Authority have been
notified of the proposed vacation and report no objection; and
WHEREAS,the rights of the residents of the City of Fort Collins will not be prejudiced or
injured by the vacation of said right-of-way.
NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the land as described on Exhibits "A" and`B"be, and the same hereby are, vacated,
abated, and abolished.
Introduced, considered favorably on first reading and ordered published this 20th day of

STREET VACATION DESCRIPTION
ABUTTING WESTBURY P.U.D. FILING TWO
A 60.00 foot street in The Ridge P.U.D., City of Fort Collins, County of Larimer, State of
Colorado lying between Lots 39 and 40 and more particularly described as beginning at
the Northeast corner of said Lot 39 and run thence N 89 degrees 19 minutes E 60.00 feet;
thence N 00 degrees 41 minutes W 60.00 feet; thence S 89 degrees 19 minutes W 281.60
feet; thence along the arc of a 15.00 foot radius curve to the right a distance of 18.11 feet,
the long chord of which bears N 56 degrees 05 minutes 30 seconds W 17.03 feet to a point
on the Easterly line of Regency Drive; thence along the said Easterly line, along the arc
of a 960.00 foot radius curve to the right a distance of 93.64 feet, the long chord of which
bears S 19 degrees 13 minutes 52 seconds E 93.61 feet; thence along the arc of a 15.00
foot radius curve to the right a distance of 27.70 feet, the long chord of which bears N 36
degrees 25 minutes 22 seconds E 23.93 feet; thence N 89 degrees 19 minutes E 191.40
feet to the point of beginning, reserving unto the City of Fort Collins, Colorado, a Municipal
Corporation a 12 foot Pedestrian Access Easement described below.
A 12.00 foot wide pedestrian access easement situate in the vacated street between Lots
39 and 40, The Ridge P.U.D., City of Fort Collins, County of Larimer, Sate of Colorado,
which begins at a point on the East line of The Ridge P.U.D. which bears N 89 degrees 19
minutes E 60.00 feet and again N 00 degrees 41 minutes W 13.13 feet from the Northeast
corner of said Lot 39 and run thence N 00 degrees 41; W 12.00 feet along the East line;
thence S 89 degrees 19 minutes W 279.94 feet to a point on the Easterly line of Regency
Drive; thence along the said Easterly line along the arc of a 960.00 foot radius curve to the
right a distance of 12.62 feet, the long chord of which bears S 18 degrees 51 minutes 21
seconds E 12.62 feet; thence N 89 degrees 19 minutes E 275.72 feet to the point of
beginning.

E 65.00 feet; thence N 89 degrees 04 minutes 40 seconds E 60.00 feet; thence N 00
degrees 55 minutes 20 seconds W 134.66 feet; thence along the arc of a 200.00 foot
radius curve to the right a distance of 77.11 feet, the long chord of which bears N 10
