HomeMy WebLinkAbout028 - 03/05/1996 - VACATING PORTIONS OF THE STREET RIGHT-OF-WAY SYSTEM IN RIDGE PUD ORDINANCE NO. 28, 1996 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING PORTIONS OF THE STREET RIGHT-OF-WAY SYSTEM IN THE RIDGE P.U.D. WHEREAS,The Ridge P.U.D.contains a 60 foot right-of-way for a street that intersects with Regency Drive; and WHEREAS,this right-of-way was originally dedicated for potential vehicular access, and has since been identified for pedestrian access only between The Ridge P.U.D. and Westbury P.U.D.; and WHEREAS, only 12 feet of right-of-way is necessary for the pedestrian access, leaving a remaining 48 feet no longer necessary for the desired access,which unneeded portion is described on Exhibit"A", attached hereto and incorporated herein by this reference (the "Regency Right-of- Way Vacated Portion"); and WHEREAS,The Ridge P.U.D.has also previously dedicated a 60 foot wide right-of-way for potential vehicular access linking The Ridge P.U.D.to the Cathy Fromme Prairie(the"Ridge Right- of-Way"),described on Exhibit`B",attached hereto and incorporated herein by this reference; and WHEREAS,The Ridge Homeowners Association has requested that the Ridge Right of Way be vacated as no longer necessary, and has offered to grant to the City a 15 foot easement approximately 500 feet to the east; and WHEREAS, the City staff agrees that such a vacation is appropriate, contingent upon The Ridge Homeowners Association granting to the City a 15 foot easement for pedestrian access and utilities; WHEREAS,the grant of easement for the pedestrian access was accepted by the Council as a Routine Grant of Easement on February 20, 1996; and WHEREAS, it is necessary and desirable to remove the portions of the rights-of-way that are no longer in use and vacate the rights-of-way for said portions; and WHEREAS,all public and private utility agencies and the Poudre Fire Authority have been notified of the proposed vacation and report no objection; and WHEREAS,the rights of the residents of the City of Fort Collins will not be prejudiced or injured by the vacation of said right-of-way. NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the land as described on Exhibits "A" and`B"be, and the same hereby are, vacated, abated, and abolished.
