HomeMy WebLinkAbout122 - 08/17/1999 - APPROPRIATING PRIOR YEAR RESERVES FOR THE MASON STREET TRANSPORTATION CORRIDOR CAPITAL PROJECT ORDINANCE NO. 122, 1999 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING PRIOR YEAR RESERVES IN THE SALES AND USE TAX FUND FOR TRANSFER TO THE BUILDING COMMUNITY CHOICES STREETS AND TRANSPORTATION CAPITAL PROJECTS FUND AND APPROPRIATING FUNDS THEREIN FOR THE MASON STREET TRANSPORTATION CORRIDOR CAPITAL PROJECT WHEREAS,on April 8, 1997,the voters of the City of Fort Collins approved Ordinance No. 20, 1997, extending a 0.25 cent sales and use tax to finance the Building Community Choices Capital Improvement Plan for streets and transportation projects; and WHEREAS, one of the transportation projects approved for funding is the Mason Street Transportation Corridor(the "Corridor"); and WHEREAS, the Corridor project is needed to create a facility dedicated to the north/south flow of bicycles, buses, and pedestrians, and the initial phase of the project includes acquiring the right to use the corridor right-of-way, creating a detailed corridor plan and the design of a multi- modal transportation facility, and constructing a bikeway from Prospect Road, south to Harmony Road; and WHEREAS, on December 14, 1998, the City entered into an agreement with Balloffet& Associates, Inc. (`Balloffet") for the planning, engineering/design of the Corridor; and WHEREAS, to complete the Corridor design, the scope of work for Balloffet needs to be amended to include a detailed user origin and destination study for the Corridor; and WHEREAS, amending the original scope of work as presented to Balloffet will cost $253,848, and all but $127,000 of this amount is available from existing appropriations in the Building Community Choices Streets and Transportation Capital Projects Fund, Mason Street Transportation Corridor capital project; and WHEREAS, funds are available from the excess sales and use tax revenues collected in 1998; and WHEREAS, the aforementioned excess revenues are in the prior year reserves of the Sales and Use Tax Fund; and WHEREAS, Article V, Section 9 of the Charter of the City of Fort Collins, (the "Charter") permits the City Council to appropriate by ordinance at any time during the fiscal year such funds for expenditure as may be available from reserves accumulated in prior years,notwithstanding that such reserves were not previously appropriated; and WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project, provided the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, it is the desire of the Council to appropriate$328,103 from prior year reserves in the Sales and Use Tax Fund for transfer to the Building Community Choices Streets and Transportation Capital Projects Fund,and appropriate$127,000 of said amount in the Mason Street Corridor capital project. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated from prior year reserves in the Sales and Use Tax Fund the sum of THREE HUNDRED TWENTY-EIGHT THOUSAND ONE HUNDRED THREE DOLLARS ($328,103), for transfer to the Building Community Choices Streets and Transportation Capital Projects Fund. Section 2. That there is hereby appropriated for expenditure from revenue transferred to the Building Community Choices Streets and Transportation Capital Projects Fund,from the Sales and Use Tax Fund,the sum of ONE HUNDRED TWENTY-SEVEN DOLLARS ($127,000)to be used for the Mason Street Transportation Corridor capital project. Introduced, considered favorably on first reading, and ordered published this 3rd day of August, A.D. 1999, and to be presented for final passage on the 17th day of August, A.D. 1999.
