HomeMy WebLinkAbout001 - 01/21/2003 - APPROPRIATING PRIOR YEAR RESERVES IN THE OPEN LANDS FUND REPRESENTING REIMBURSEMENT FROM THE GREAT O ORDINANCE NO. 001, 2003 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING PRIOR YEAR RESERVES IN THE OPEN LANDS FUND REPRESENTING REIMBURSEMENT FROM THE GREAT OUTDOORS COLORADO TRUST FUND TO BE USED FOR THE ACQUISITION OF OPEN SPACE, TRAILS, AND NATURAL AREAS WHEREAS, the Board of the Great Outdoors Colorado Trust Fund (the "GOCO Board") created a statewide Legacy Project Grant Program designed to further wildlife programs through the Colorado Division of Wildlife ("DOW"); outdoor recreation programs through the Colorado Division of Parks and Outdoor Recreation ("DPOR"); open space and natural areas programs through the DPOR,DOW,municipalities,counties,or nonprofit land conservation entities;and local government open space, trails and other outdoor recreation facilities; and WHEREAS, the goal of the Legacy Project Grant Program is to bring together public and private organizations in a spirit of cooperation and with a common goal to complete projects of state- wide benefit; and WHEREAS, in 1996, the City of Fort Collins, City of Greeley, City of Loveland, Estes Valley Park and Recreation District,Larimer County,Town of Windsor, Weld County, the Nature Conservancy, Poudre River Trail Corridor, Inc., DOW, and DPOR submitted a detailed project application to the GOCO Board for the completion of the project entitled the Poudre-Big Thompson Rivers Legacy Project, which was approved by the GOCO Board in the amount of$3,400,000, on October 23, 1996 (the "Phase I Grant"); and WHEREAS, in September 1998, the Council adopted Resolution 98-128, authorizing the City Manager to enter into the Poudre-Big Thompson Rivers Legacy Project Grant Agreement with the GOCO Board, together with the City of Greeley, City of Loveland, Estes Valley Park and Recreation District,Larimer County,Town of Windsor,Weld County,the Nature Conservancy,and Poudre River Trail Corridor,Inc.,regarding the Phase I Grant,together with a related Memorandum of Understanding amongst the grant partners; and WHEREAS, on January 18, 2000, the Council adopted Resolution 2000-14, authorizing amendments to the existing grant and agreements, including approval by the GOCO Board of an additional $2,500,000 (the "Phase H Grant") to provide for the completion of additional riparian corridor protection, trail construction, and environmental learning site improvements; and WHEREAS,the Phase I Grant and the Phase H Grant,collectively referred to as the"Legacy Grant Project", provide for reimbursement to participating grant recipients for a portion of the cost of acquiring open space or natural area properties,consistent with the work plan for the Legacy Grant Project; and WHEREAS, in 1996, the City of Fort Collins acquired approximately 30.6 acres of land located east of Lemay Avenue and south of Mulberry Avenue, and known as Nix Natural Area, for the purchase price of$475,515; and WHEREAS,also in 1996,the City purchased an undivided 32%interest in 98.29 acres of land between Mulberry Avenue and Prospect Road to the east and west adjacent to Timberline Road,for the purchase price of$400,000, and accepted the donation of an additional 68% undivided interest in the property; and WHEREAS, since 1996, the City has used 4.2 acres of the aforementioned property as part of the extension of Timberline Road, and designated the remainder of the property as two separate natural areas, Kingfisher Point Natural Area and Cattail Chorus Natural Area; and WHEREAS,in 1998,the City acquired approximately 17.5 acres of land located north of the Cache La Poudre River to east of Shields Street, and referred to as the McMurry Annex/Ackerman Court Property, for the purchase price of$250,000; and WHEREAS, staff, in consultation with the staff of the GOCO Board identified the aforementioned properties as land for which a portion of the acquisition costs, totaling $772,000, may appropriately be reimbursed under the Legacy Grant Project, as follows: Nix Natural Area (29.94 acres) $ 394,500 Cattail Chorus Natural Area (34.48 acres) 135,000 McMurry Annex/Ackerman Court Property (17.5 acres) 242,500 Total $ 772,000 and WHEREAS, additionally, City Council approved the appropriation of a reimbursement by the GOCO Board under the Legacy Grant Project for a portion (80 acres) of the Cathy Fromme Prairie, in 2000, via Ordinance No. 49, 2000, in the amount of$235,000; and WHEREAS,following further negotiations between City staff and the GOCO Board,GOCO has awarded the City an additional $15,000 reimbursement, associated with the 80-acre portion of the Cathy Fromme Prairie; and WHEREAS, the City received reimbursement in the amount of$787,000 from the GOCO Board in 2002,for the properties described above,and said funds were deposited in the City's Open Lands Fund; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the "Charter") permits the Council to appropriate by ordinance at any time during the fiscal year such funds for expenditure as may be available from reserves accumulated in prior years,notwithstanding that such reserves were not previously appropriated; and WHEREAS,it is the desire of the Council to appropriate$787,000 from prior year reserves in the Open Lands Fund to be used for the acquisition of open space, trails, and natural areas. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated from prior year reserves in the Open Lands Fund, the sum of SEVEN HUNDRED EIGHTY-SEVEN THOUSAND DOLLARS($787,000)to be used for the acquisition of open space trails, and natural areas. Introduced, considered favorably on first reading, and ordered published this 7th day of January, A.D. 2003, and to be presented for final passage on the 21 st y of January, D. 2003.
