HomeMy WebLinkAbout154 - 11/19/2002 - APPROPRIATING PRIOR YEAR RESERVES DESIGNATED FOR COMMUNITY PARK IMPROVEMENTS IN THE CAPITAL IMPROVEM ORDINANCE NO. 154, 2002 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING PRIOR YEAR RESERVES DESIGNATED FOR COMMUNITY PARK IMPROVEMENTS IN THE CAPITAL IMPROVEMENT EXPANSION FUND FOR THE PURPOSE OF CONSTRUCTING INFRASTRUCTURE IMPROVEMENTS AND ACQUIRING RAW WATER FOR WEBSTER COMMUNITY PARK WHEREAS,the current Parks and Recreation Policy Plan, which was approved by the City Council with the adoption of Resolution 96-146 in December 1996, recommends that community parks be developed at a standard of 4.5 acres per 1,000 population; and WHEREAS,the southeast section of the community will need to be served by a 50 to 60 acre community park based on the projected density of residential development; and WHEREAS, the City and Poudre School District developed a site plan for development of a 160-acre site located one mile south of Harmony Road, along Ziegler Road, Kechter Road, and Rock Creek Drive as a joint location for a new high school,opening in 2004,and a community park; and WHEREAS,the aforementioned site was presented to the Parks and Recreation Board (the "Board")on April 25 and October 24,2001,at which time the Board voted in support of the site for a community park; and WHEREAS,March 5,2002,City Council adopted Ordinance No. 30,2002, authorizing the appropriation of prior year reserves designated for community parkland improvements in the Capital Improvement Expansion Fund,for the purpose of acquiring a 53.653-acre site from Poudre School District ($1,475,493) for the site of a community park in the southeast section of the City (the "Webster Site"),and for the City's share of the costs for improvements to Kechter Road,which runs along the southern boundary of the Webster Site ($1,062,315); and WHEREAS, while a community park in the southeast section of the City is not scheduled for opening until 2008, the City can realize a savings by sharing in the cost of infrastructure being constructed by Poudre School District in conjunction with the construction of the new high school, which infrastructure will also eventually serve the Webster site; and WHEREAS,the aforementioned joint infrastructure improvements include water,sewer,and electrical utility services; construction of an irrigation pond with pumping plant and a shared irrigation system;two lighted tennis courts; a lighted ballfield and associated landscaping; and road improvements allowing access to the property, at an estimated cost of$1,500,000; and WHEREAS,an additional$1,000,000 is requested to allow the City to acquire raw water for the proposed park in an effort to avoid higher costs in the future; and WHEREAS, staff recommends that the joint City/Poudre School District infrastructure improvements at the Webster Site be funded from prior year reserves accumulated in the Capital Improvement Expansion Fund for community park improvements; and WHEREAS,City Code Section 7.5-28(a)requires that capital improvement expansion fees for community park improvements be used only for capital improvements related to the provision of community parks, as such improvements may be identified in the capital improvements plan for community parkland; and WHEREAS,costs associated with constructing infrastructure improvements and acquiring raw water at the future site of a southeast community park are identified in, and consistent with the Parks and Recreation Policy Plan adopted by the City Council in Resolution 96-147 on December 3, 1996, and updated in 1999, and are also included in the City's Ten-Year Capital Improvement Plan and Inventory (2001-2010); and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the "Charter") permits the City Council to appropriate by ordinance at any time during the fiscal year such funds for expenditure as may be available from reserves accumulated in prior years, notwithstanding that such reserves were not previously appropriated; and WHEREAS, it is the desire of the Council to appropriate the sum of$2,500,000 from prior year reserves designated for community park improvements in the Capital Improvement Expansion Fund for transfer to the Capital Projects Fund-Webster Park project, for appropriation therein,for the purpose of constructing infrastructure improvements and acquiring raw water for Webster Park. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated from prior year reserves designated for community park improvements in the Capital Improvement Expansion Fund, the sum of TWO MILLION FIVE HUNDRED THOUSAND DOLLARS ($2,500,000), for transfer to the Capital Projects Fund - Webster Park project, and appropriated therein to be used for constructing infrastructure improvements and acquiring raw water for Webster Park. Introduced and considered favorably on first reading and ordered published this 5th day of November, A.D. 2002, and to be presented for final passage on the 19th day of November, A.D. 2002.
