HomeMy WebLinkAbout137 - 10/01/2002 - APPROPRIATING UNANTICIPATED REVENUE TO BE USED FOR IMPROVEMENTS TO GATEWAY MOUNTAIN PARK ORDINANCE NO. 137, 2002 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND - GATEWAY MOUNTAIN PARK CAPITAL PROJECT AND THE CONSERVATION TRUST FUND FOR TRANSFER TO THE CAPITAL PROJECTS FUND - GATEWAY MOUNTAIN PARK CAPITAL PROJECT TO BE USED FOR IMPROVEMENTS TO GATEWAY MOUNTAIN PARK WHEREAS,the City of Fort Collins owns a 377-acre site located approximately five miles up the Poudre Canyon, which property was formerly known as the City's Water Treatment Plant No.1, a portion of which has been developed as Gateway Mountain Park (the "Park"); and WHEREAS, on June 26, 2002, the City celebrated the grand opening of the Park; and WHEREAS, the scope of improvements at the Park included realignment and substantial improvements to the entry road to the Park from Highway 14,constructing interior access roads and parking,picnic shelters,restrooms,fencing,landscaping,an irrigation system,an interpretive facility, and a walking path; and WHEREAS, the cost of the aforementioned improvements is $1,390,000, including a contingency for possible additional work that may be required of approximately $50,000; and WHEREAS,to date City Council has adopted ordinances appropriating a total of$1,110,000 for improvements to the Park from the following sources: Ordinance No. 135, 1998 General Fund $ 200,000 Open Lands Fund 210,000 Conservation Trust Fund 110,000 Colorado Department of Transportation 144,000 Total $ 664,000 Ordinance No. 71, 1999 Colorado Department of Transportation $ 59,000 Ordinance No. 5, 2000 Colorado Department of Transportation $ 170,000 Larimer County 35,000 Total $ 205,000 Ordinance No. 9, 2001 Colorado Department of Transportation $ l 82,000 Grand Total $ 1,1109000 and; WHEREAS, an additional appropriation, totaling $280,000, is needed to fully fund the improvements at the Park, including the amount designated as contingency funds; and WHEREAS,the Great Outdoors Colorado Trust Fund and the Colorado Division of Wildlife have made available to the City a total of$100,000 and$80,000,respectively,to reimburse the Park project for certain improvements that have been constructed in the interior of the Park using previously available contingency funds; and WHEREAS,City staff has identified an additional $100,000 in unanticipated revenue from lottery proceeds in the Conservation Trust Fund that staff has proposed be appropriated together with the foregoing $180,000 in grant proceeds to fully fund the construction of the Park and related improvements; and WHEREAS,Article V, Section 9, of the Charter of the City of Fort Collins (the "Charter") permits the City Council to make supplemental appropriations,by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year, does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, City staff has determined that the appropriation of funds from Great Outdoors Colorado, the Division of Wildlife, and the Conservation Trust Fund as described herein will not cause the total amount appropriated in the Capital Projects Fund-Gateway Mountain Park capital project and the Conservation Trust Fund to exceed the current estimate of actual and anticipated revenues to be received during any fiscal year; and WHEREAS,it is the desire of the Council to appropriate the sum of$180,000 in the Capital Projects Fund - Gateway Mountain Park project, representing grant proceeds from the Great Outdoors Colorado Trust Fund ($100,000) and the Colorado Division of Wildlife ($80,000), and $100,000 in Conservation Trust Fund for transfer to the Capital Projects Fund-Gateway Mountain Park capital project for appropriation therein to be used for improvements to Gateway Mountain Park. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the sum of ONE HUNDRED EIGHTY THOUSAND DOLLARS ($180,000) is hereby appropriated in the Capital Projects Fund - Gateway Mountain Park capital project from the following sources: Great Outdoors Colorado Trust Fund (GOCO) Grant Proceeds $ 100,000 Colorado Division of Wildlife (DOW) Grant Proceeds 80,000 Total $ 180,000 to be used for improvements to Gateway Mountain Park. Section 2. That there is hereby appropriated from unanticipated revenue in the Conservation Trust Fund, the sum of ONE HUNDRED THOUSAND DOLLARS ($100,000) for transfer to the Capital Projects Fund - Gateway Mountain Park capital project and appropriated therein to be used for improvements to Gateway Mountain Park. Introduced, considered favorably on first reading and ordered published this 17th day of September, A.D. 2002, and to be presented for final passage on the 1st day of October,A.D. 2002.
