OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING PRIOR YEAR RESERVES IN THE STREET OVERSIZING FUND
AND AUTHORIZING THE TRANSFER OF APPROPRIATED AMOUNTS
TO BE USED TO CONSTRUCT IMPROVEMENTS ON LEMAY AVENUE
FROM FOSSIL CREEK TO TRILBY ROAD
WHEREAS, with the development of the Fossil Creek Community Park, arterial street
improvements are planned for Lemay Avenue adjacent to the park property; and
WHEREAS, during the past two years, City staff have been working on the design plans
for Lemay Avenue, adjacent to the Fossil Creek Park. The plans will include the realignment and
widening of Lemay Avenue to a four-lane arterial including curb, gutter, sidewalks, parkways,
bike lanes and landscaped medians; installing traffic signals at the intersections of Lemay
Avenue and Trilby Road, Lemay Avenue and Fossil Creek Boulevard, and Lemay Avenue and
Southridge Greens Boulevard; construction of a pedestrian underpass for the Fossil Creek Trail,
under Lemay Avenue; and storm water upgrades to the existing drainage crossing at Lemay
Avenue and Stonegate Drive (collectively, the "Project"); and
WHEREAS, combining the aforementioned development improvements with the park
improvements increases efficiency, reduces costs, minimizes the disruption to the traveling
public, and completes a significant section of arterial roadway; and
WHEREAS, the estimated cost of the Project is $4,872,022; and
WHEREAS, a funding strategy has been developed, and Project funds, totaling
$4,872,022, have been identified and are available from the following sources:
Street Oversizing Fund- Prior Year Reserves (including
contributions from the developers of Paragon Point) $ 2,000,000
Street Oversizing Fund- existing appropriations 1,500,596
Conservation Trust Fund- existing appropriations in the
Fossil Creek Trail project 800,000
Building Community Choices - existing appropriations in the
Fossil Creek Community Park project 3511426
Storm Drainage Fund-existing appropriations in the Developer
Repays project 220,000
$ 4,872,022
WHEREAS, expenditures relating to the storm water upgrades, totaling $220,000, will be
charged against the aforementioned appropriations in the Storm Drainage Fund - Developer
Repays project; and
WHEREAS, upon completion of the bid process, the Project is expected to begin in
March 2003, with final completion and landscaping to be completed by September 2003; and
WHEREAS, Article V, Section 9 of the Charter of the City of Fort Collins, (the
"Charter") permits the City Council to appropriate by ordinance at any time during the fiscal year
such funds for expenditure as may be available from reserves accumulated in prior years,
notwithstanding that such reserves were not previously appropriated; and
WHEREAS, Article V, Section 10, of the Charter authorizes the City Council to transfer
by ordinance any unexpended and unencumbered amount or portion thereof from one fund or
capital project to another fund or capital project, provided the purpose for which the transferred
funds are to be expended remains unchanged; and
WHEREAS, the purpose for which the previously appropriated funds in the Street
Oversizing Fund ($1,500,596), the Conservation Trust Fund - Fossil Creek Trail project
($800,000), and the Building Community Choices - Fossil Creek Community Park project
($351,426), were initially appropriated remains the same, and the City Manager has
recommended that said unspent and unencumbered funds be transferred to the Capital Projects
Fund - Lemay Avenue, Fossil Creek to Trilby Improvements project and that such funds be
earmarked for expenditures associated with the proposed Lemay Avenue Improvements; and
WHEREAS, it is the desire of the Council to appropriate $2,000,000 from prior year
reserves in the Street Oversizing Fund and authorize the transfer of said amount to the Capital
Projects Fund - Lemay Avenue, Fossil Creek to Trilby Improvements project, for appropriation
therein, and to authorize the transfer of existing appropriations totaling $1,500,596 in the Street
Oversizing Fund, $800,000 in the Conservation Trust Fund - Fossil Creek Trail project, and
$351,426 in the Building Community Choices - Fossil Creek Community Park project, to the
Capital Projects Fund - Lemay Avenue, Fossil Creek to Trilby Improvements project to be used
for expenditures associated with the Lemay Avenue Improvements.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1. That there is hereby appropriated for expenditure from prior year reserves
in the Street Oversizing Fund for transfer to the Capital Projects Fund - Lemay Avenue, Fossil
Creek to Trilby Improvements project and appropriated therein the sum of TWO MILLION
DOLLARS ($2,000,000) to be used for expenditures associated with the proposed Lemay
Avenue,Fossil Creek to Trilby improvements.
Section 2. That the unexpended appropriated amount of ONE MILLION FIVE
HUNDRED THOUSAND FIVE HUNDRED NINETY-SIX DOLLARS ($1,500,596) is hereby
authorized for transfer from the Street Oversizing Fund to the Capital Projects Fund - Lemay
Avenue, Fossil Creek to Trilby Improvements project and appropriated therein to be used for
expenditures associated with the proposed Lemay Avenue, Fossil Creek to Trilby improvements.
Section 3. That the unexpended appropriated amount of EIGHT HUNDRED
THOUSAND DOLLARS ($800,000) is hereby authorized for transfer from the Conservation
Trust Fund - Fossil Creek Trail project to the Capital Projects Fund - Lemay Avenue, Fossil
Creek to Trilby Improvements project and appropriated therein to be used for expenditures
associated with the proposed Lemay Avenue,Fossil Creek to Trilby improvements.
Section 4. That the unexpended appropriated amount of THREE HUNDRED FIFTY-
ONE THOUSAND FOUR HUNDRED TWENTY-SIX DOLLARS ($351,426) is hereby
authorized for transfer from the Building Community Choices - Fossil Creek Community Park
project to the Capital Projects Fund - Lemay Avenue, Fossil Creek to Trilby Improvements
project and appropriated therein to be used for expenditures associated with the proposed Lemay
Avenue, Fossil Creek to Trilby improvements.
Introduced and considered favorably on first reading and ordered published this 21 st day
of January, A.D. 2003, and to be presented for final passage on the 4th day of February, A.D.
