HomeMy WebLinkAbout003 - 01/21/2003 - AUTHORIZING THE TRANSFER OF APPROPRIATIONS FROM THE SHELDON LAKE IMPROVEMENTS CAPITAL PROJECT TO THE ORDINANCE NO. 003, 2003 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE TRANSFER OF APPROPRIATIONS FROM THE SHELDON LAKE IMPROVEMENTS CAPITAL PROJECT TO THE CITY PARK POOL RENOVATION CAPITAL PROJECT FOR THE PURPOSE OF CONSTRUCTING A WATER PLAY STRUCTURE FOR THE OUTDOOR POOL WHEREAS, on March 5, 2002, City Council adopted Ordinance No. 029, 2002, appropriating a donation of$175,000 from the Don and May Wilkins Charitable Trust(the"Trust"), $125,000 in Community Parkland Capital Improvement Expansion Fees, and in-kind services donated by the Elks B.P.O.E.#804 valued at$125,000 to be used to fund improvements to Sheldon Lake in City Park; and WHEREAS, the aforementioned improvements included constructing a boardwalk around the outdoor pool and providing irrigation and landscaping along the west and south shores, constructing a stone wall along City Park Drive, a storage shed adjacent to the Trolley Barn, improvements to City Park Center, and to purchase new paddleboats for the recreation boating program at Sheldon Lake; and WHEREAS, representatives for the Trust and City staff would like to reallocate funding totaling$85,000,which is presently designated for replacement of the wooden retaining wall along City Park Drive with a stone wall, and to instead use those funds for a water play structure for the outdoor pool; and WHEREAS,the existing wooden retaining wall is still functional and not in immediate need of replacement, and the reallocation will not affect the City's ability to complete the boardwalk and shoreline restoration work at Sheldon Lake; and WHEREAS, under Article V, Section 10 of the Charter of the City of Fort Collins,the City Council may, by ordinance, upon the request of the City Manager, transfer any unexpended and unencumbered appropriated amount or portion thereof from one fund or capital project to another fund or capital project provided that the purpose for which the transferred funds are to be expended remains unchanged;the purpose for which the funds were initially appropriated no longer exists; or the proposed transfer is from a fund or capital project account in which the amount appropriated exceeds the amount needed to accomplish the purpose specified in the appropriation ordinance;and WHEREAS, it is the desire of the Council to authorize the transfer of $85,000 from the City's Capital Projects Fund - Sheldon Lake Improvements project to the City's Capital Projects Fund- City Park Pool Renovation project, to be used to fund a water play structure for the outdoor pool. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the unexpended appropriated amount of EIGHTY-FIVE THOUSAND DOLLARS ($85,000) is hereby authorized for transfer from the Capital Projects Fund - Sheldon Lake Improvements project to the Capital Projects Fund-City Park Pool Renovation project, to be used to fund a water play structure for the outdoor pool. Introduced and considered favorable on first reading and ordered published this 7th day of January, A.D. 2003, and to be presented for final passage on the 21st day of January, A.D. 2003.
