HomeMy WebLinkAbout188 - 12/02/1997 - GRANTING EASEMENTS TO SOUTH FORT COLLINS SANITATION DISTRICT AND JAMES CONSTRUCTION CO., INC., VACAT ORDINANCE NO. 188, 1997 OF THE COUNCIL OF THE CITY OF FORT COLLINS GRANTING A SEWER LINE EASEMENT TO THE SOUTH FORT COLLINS SANITATION DISTRICT, GRANTING STORM DRAINAGE EASEMENTS TO THE JAMES CONSTRUCTION CO. INC., VACATING A PORTION OF A GRANT OF EASEMENT FOR CONSERVATION AND ACCEPTING A NEW CONSERVATION EASEMENT IN CONNECTION WITH STANTON CREEK 1 ST FILING WHEREAS,the City of Fort Collins is the owner of real property located in Larimer County, Colorado, known as Fossil Creek Wetlands Natural Area ("Property"); and WHEREAS,in connection with this project,the South Fort Collins Sanitation District wishes to acquire a sewer line easement, described on Exhibit "A", attached hereto and incorporated by reference,under and through the Property to provide sewer service to Stanton Creek 1 st Filing; and WHEREAS, in connection with this project, the James Construction Co., Inc. wishes to acquire drainage easements, described on Exhibits "B" and"C", attached hereto and incorporated by reference, under and through the Property to provide stormwater drainage facilities; and WHEREAS,the James Construction Co., Inc. is requesting that the City vacate a 0.45 acre parcel of a conservation easement, described on Exhibit "D", attached hereto and incorporated by reference, in exchange for the James Construction Co.,Inc. dedicating a 0.499 acre parcel to the City for the conservation easement, described on Exhibit "E", attached hereto and incorporated by reference; and WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized to sell, convey or otherwise dispose of real property owned by the City,provided the Council first finds by ordinance that any sale or disposition of real property owned by the City is in the best interest of the City of Fort Collins; and WHEREAS,the Natural Resources Department has recommended approval of the sewer line and storm drainage easements and the vacation of a portion of the conservation easement by ordinance and acceptance of the dedication of the replacement conservation easement; and WHEREAS,the rights of the residents of the City of Fort Collins will not be prejudiced or injured by the vacation of said conservation easement. NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the conveyance of the above-referenced easements under and through the Property is in the best interest of the City of Fort Collins. Section 2. That the City Manager is hereby authorized to execute an Easement Agreement conveying an easement for the purpose of installation, operation and maintenance of a sanitary sewer line as described on Exhibit"A"to the South Fort Collins Sanitation District, which Easement Agreement shall require a payment to the City for the easement, equal to the fair market value of such easement. Section 3. That the City Manager is hereby authorized to execute Easement Agreements conveying easement interests for the purposes of installation, operation and maintenance of stormwater drainage facilities as described on Exhibits"B"and"C"to the James Construction Co., Inc., which Easement Agreements shall require a payment to the City for the easements, equal to the fair market value of the same. Section 4. That that certain portion of the Conservation Easement described on Exhibit "D"be, and the same hereby is, vacated, abated, and abolished. Section 5. That the City Council hereby accepts the Deed of Easement conveying easement interests for the conservation easement as described on Exhibit "E" to the City of Fort Collins.
