HomeMy WebLinkAbout164 - 11/04/1997 - AUTHORIZING TRANSFER OF APPROPRIATIONS FOR THE ART IN PUBLIC PLACES PROGRAM (TIMBERLINE ROAD EXTENSI ORDINANCE NO. 164, 1997 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN THE DRY CREEK BASIN CAPITAL PROJECT AND THE ART IN PUBLIC PLACES RESERVE ACCOUNT IN THE STORM DRAINAGE FUND TO BE USED FOR THE ART IN PUBLIC PLACES PROGRAM WHEREAS, the City Council adopted Ordinance No. 118, 1997, on August 5, 1997, appropriating prior year reserves,totaling$1,200,000,in the Storm Drainage Fund for the Dry Creek Basin capital project to be used to construct the Dry Creek Channel from the Fort Collins Downtown Airport to the Poudre River; and WHEREAS,Section 23-304 of the City Code,provides that all requests submitted to the City Council for appropriations for construction projects estimated to cost over$250,000 shall include an amount equal to 1% of the estimated cost of such project for works of art; and WHEREAS, one percent of the $1,200,000 appropriated for the Dry Creek Basin capital project by Ordinance No. 118, 1997, or$12,000, should have been appropriated in the Art in Public Places Reserve Account in the Storm Drainage Fund; and WHEREAS, Article V, Section 10, of the Charter of the City of Fort Collins authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project, provided that the purpose for which the transferred funds are to be expended unchanged; and WHEREAS, it is the desire of the Council to authorize the transfer of$12,000 from the Dry Creek Basin capital project in the Storm Drainage Fund to the Art in Public Places Reserve Account in the Storm Drainage Fund, to be used with existing appropriations in the Art in Public Places Reserve Account in the Cultural Services and Facilities Fund, for the landscape sculpture proposed by artist Robert Tully as part of the Timberline Road Extension and Dry Creek Channel Improvements Project. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the unexpended appropriated amount of TWELVE THOUSAND DOLLARS ($12,000) is hereby authorized for transfer from the Dry Creek Basin capital project in the Storm Drainage Fund to the Art in Public Places Reserve Account in the Storm Drainage Fund, to be used with existing appropriations in the Cultural Services and Facilities Fund for the landscape sculpture proposed by artist Robert Tully as part of the Timberline Road Extension and Dry Creek Basin Channel Improvements Project.
