HomeMy WebLinkAbout145 - 10/21/1997 - AUTHORIZING A LAND LEASE OF PROPERTY AT THE TRANSFORT FACILITY TO THE COLORADO STATE PATROL FOR THE ORDINANCE NO. 145, 1997 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING A LAND LEASE OF CITY-OWNED PROPERTY AT THE TRANSFORT FACILITY TO THE STATE OF COLORADO, COLORADO STATE PATROL DIVISION FOR THE TEMPORARY RELOCATION OF THE HIGHWAY PATROL OFFICE IN FORT COLLINS WHEREAS,the City's Timberline Road Improvement Project will impair and in part prevent the use by the Colorado State Highway Patrol ("CSP") of its office located at 2412 East Mulberry Street in Fort Collins; and WHEREAS, as a result, City staff believes that it is in the City's best interest to purchase the CSP office building and cooperate with CSP in relocating its office facilities; and WHEREAS, to reduce the costs to the City and CSP associated with the relocation of the CSP office, City staff has negotiated an agreement through which the City will provide a temporary location for the CSP office, pending completion of CSP's new facilities; and, WHEREAS, the City of Fort Collins is the owner of the property at 6570 Portner Road,Fort Collins, Larimer County, Colorado, commonly known as the Transfort Facility; and WHEREAS, the ground lease of a portion of the Transfort Facility that would permit the temporary installation by CSP of a modular office building would satisfy CSP's interim needs, and would not impair the City's own use of the Transfort Facility; and WHEREAS, under Section 23-114 of the Code of the City of Fort Collins, the Council is authorized to lease any and all interests in real property owned in the name of the City,provided that Council first finds that the lease is in the best interests of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Council hereby determines that the proposed lease of that certain portion of the City's Transfort Facility described on Exhibit A, attached hereto and incorporated herein by this reference,to the Colorado State Highway Patrol for a term of one year, with two optional one-year renewals, at an annual rate of Ten Dollars ($10.00), is in the best interests of the City, and hereby authorizes the City Manager to enter into a Lease Agreement consistent with the terms hereof.
