HomeMy WebLinkAbout138 - 10/07/1997 - APPROPRIATING GRANT REVENUE AND AUTHORIZING TRANSFER OF APPROPRIATIONS FOR THE OPERATION OF THE 1997 ORDINANCE NO. 138, 1997 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING FEDERAL GRANT REVENUE AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN PROJECTS IN THE TRANSPORTATION SERVICES FUND FOR THE OPERATION OF THE NORTH FRONT RANGE TRANSPORTATION & AIR QUALITY PLANNING COUNCIL'S 1997-1998 METROPOLITAN PLANNING ORGANIZATION ADMINISTRATION PROGRAM YEAR WHEREAS,the North Front Range Transportation& Air Quality Planning Council is the Metropolitan Planning Organization ("MPO") and lead air quality planning agency for the north front range; and WHEREAS,voting members of the MPO include Fort Collins, Greeley, Loveland, Evans, Timnath, Windsor, Berthoud, LaSalle, Garden City, the Colorado Department of Transportation ("CDOT") and the Colorado Department of Public Health& Environment; and WHEREAS,the funds for the administration of the MPO program are federal transportation program funds appropriated by the federal government and administered by CDOT, based on the federal fiscal year of October 1 st through September 30th; and WHEREAS, the City will receive in MPO program year 1997-1998, federal grant revenue from various federal transportation programs,totaling $279,664, and along with required matching funds from MPO member entities (excluding the City of Fort Collins' share), totaling $52,755, to be used to provide coordinated, comprehensive and cooperative transportation and air quality planning services in the North Front Range region; and WHEREAS, the City of Fort Collins' share for supporting the 1997-1998 MPO program, totaling $6,265, will be included in the City's 1998-1999 Proposed Budget; and WHEREAS,Article V, Section 11, of the Charter of the City of Fort Collins(the"Charter") provides that appropriations for a federal grant shall not lapse if unexpended at the end of the fiscal year until the expiration of the federal grant; and WHEREAS, CDOT will permit unexpended funds remaining in the 1996-1997 MPO program in the amount of$88,049 to be reallocated and used for the 1997-1998 MPO year; and WHEREAS, Article V, Section 9, of the Charter permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year,do not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project provided that the purpose for which the funds were initially appropriated remains unchanged; and WHEREAS, City staff has determined that the appropriation of federal grant revenues administered through CDOT and unanticipated local matching shares from MPO member entities will not cause total appropriations to exceed the current estimate of actual and anticipated revenues to be received during any fiscal year. NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS AS FOLLOWS: Section 1. That there is hereby appropriated for expenditure from federal grant revenue in the Transportation Services Fund, 1997-1998 Metropolitan Planning Organization program,the sum of TWO HUNDRED SEVENTY-NINE THOUSAND SIX HUNDRED AND SIXTY-FOUR DOLLARS ($279,664),upon receipt from federal fiscal year 1997-1998 funds administered through the CDOT to be used for the 1997-1998 MPO program year. Section 2. That there is hereby appropriated from federal grant program revenue in the Transportation Services Fund, 1997-1998 MPO program, the sum of FIFTY-TWO THOUSAND SEVEN HUNDRED FIFTY-FIVE DOLLARS ($52,755)upon receipt from MPO member entities local shares to be used for the 1997-1998 MPO program year. Section 3. That the unexpended and unencumbered amount of EIGHTY-EIGHT THOUSAND AND FORTY-NINE DOLLARS ($88,049) is hereby authorized for transfer from the 1996-1997 MPO grant program to the 1997-1998 MPO grant program, upon the effective date of this Ordinance.
