HomeMy WebLinkAbout117 - 10/19/1993 - AUTHORIZING THE DISPOSITION OF CUNNINGHAM CORNER BARN ORDINANCE NO. 117, 1993 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE DISPOSITION OF CERTAIN REAL PROPERTY KNOWN AS THE CUNNINGHAM CORNER BARN WHEREAS, on July 21, 1993, the Council of the City of Fort Collins (the "Council") adopted Ordinance 79, 1993, which authorized the sale of a tract of land in the Cunningham Corner PUD to Shields Street Corporation; and WHEREAS, a condition of the sale was the removal of certain improvements on the site known as the Cunningham Corner Barn (the "Barn") ; and WHEREAS, on July 6, the Council adopted Resolution 93-103 which specified that: 1) the Barn be relocated to private property within the Urban Growth Area; 2) a Request for Proposals ("RFP") be issued to identify those parties interested in obtaining the Barn for private use and to select an appropriate site for the Barn; and 3) the relocation of the Barn be funded from the Historic Preservation Account within the Capital Projects Fund; and WHEREAS, the RFP was issued and proposals were evaluated according to the requirements set forth in Chapter 8 of the Code of the City of Fort Collins; and WHEREAS, the committee reviewing the proposals recommended that the Barn be relocated to private property owned by Doug and Patti Leidholt; and WHEREAS, upon relocation of the Barn, the Leidholts have agreed to apply for landmark designation of the Barn under the provisions of Chapter 14 of the City Code, to restore the Barn pursuant to the provisions of Article III thereof in a location visible to the public, and to make portions of the Barn accessible to school age children as a showplace for vintage agricultural implements; and WHEREAS, Section 23-111(a) of the Code provides that the Council is authorized to sell , convey or otherwise dispose of any and all interests in real property owned in the name of the City whether the interest in real property was obtained by tax deed or otherwise; and WHEREAS, sufficient funds are appropriated and available in the Historic Preservation Account of the Capital Projects Fund to pay for the cost of relocating the Barn; and WHEREAS, the Council of the City of Fort Collins has determined it is in the best interests of the citizens of Fort Collins to fund the relocation of the Barn so as to ensure its preservation and its utilization for historic purposes as described above. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Purchasing Agent is hereby authorized to enter into an agreement with Doug and Patti Leidholt for the relocation of the Cunningham Corner Barn to the property located at 3818 Richmond Drive in the City of Fort Collins at a cost to the City not to exceed Twenty Thousand Dollars (E20,000) , upon the following terms and conditions: That, within 30 days of the date of passage of this ordinance, the Leidholts will apply for landmark designation of the Barn under the provisions of Chapter 14 of the City Code, and, upon designation of the Barn and relocation of the same to their property at City expense, they will fund the restoration of the Barn in accordance with the procedures contained in Chapter 14, Article III of the Code, with such renovation to be completed no later than September 1, 1994. That, within 60 days of the date of final passage of this Ordinance, the Leidholts will make available the future site for the Barn, on property owned by them, in a location clearly visible to the general public; and That, for a period of no less than five (5) years from the time the restoration of the Barn is complete, the Leidholts, or their successors in interest, will utilize a portion of the interior of the Barn as a showplace for vintage agricultural implements and will work with the Poudre School District R-1 to make the Barn available for visitation by school age children on a regular basis.
