HomeMy WebLinkAbout115 - 10/19/1993 - GRANTING A CABLE TV FRANCHISE TO THE WORLD COMPANY DOING BUSINESS AS COLUMBINE CABLEVISION ORDINANCE NO. 115, 1993 OF THE COUNCIL OF THE CITY OF FORT COLLINS GRANTING A CABLE TV FRANCHISE TO THE WORLD COMPANY, DOING BUSINESS AS COLUMBINE CABLEVISION WHEREAS, on November 7, 1978, the electors of the City of Fort Collins approved the granting of a cable TV franchise to The World Company, doing business as Columbine CableVision, ("Columbine") ; and WHEREAS, this franchise granted to Columbine in 1978 will expire on November 6, 1993; and WHEREAS, representatives of Columbine and the City have been involved in negotiations for the past several months relating to the City granting a new cable TV franchise to Columbine; and WHEREAS, these negotiations have resulted in a proposed franchise agreement that has been presented to the City Council for its consideration and approval ("the Franchise Agreement") ; and WHEREAS, the Franchise Agreement includes the following major terms and conditions: (1) a term of 15 years unless Columbine sells its cable system, in which event the term shall become 12 years, (2) a requirement that Columbine upgrade its current system to a 76 channel , 550 megahertz, state-of-the-art system within four years of the effective date of the granting of the new franchise, with the possibility of an 18-month extension under certain conditions, and (3) a requirement that Columbine pay to the City a franchise fee of five percent of the gross revenues Columbine receives from the operation of its cable system; and WHEREAS, Council has considered the Franchise Agreement, as well as the Cable TV Board's recommendation, and after having done so, has determined that the granting of a cable tv franchise to Columbine under the terms and conditions of the Franchise Agreement is in the best interests of the City and its citizens; and WHEREAS, Section I of Article XI of the City Charter and Section 6-3 of the City Code set forth notice requirements that must be satisfied prior to the City granting a cable tv franchise. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Council finds that the notice requirements of Section 1 of Article XI of the City Charter and Section 6-3 of the City Code relating to the granting of a cable tv franchise have been satisfied with respect to the granting of a cable tv franchise to Columbine under the terms and conditions of the Franchise Agreement. Section 2. That the Council finds that the City's granting of a cable tv franchise to Columbine in accordance with the terms and conditions of the Franchise Agreement is in the best interests of the City and its citizens. Section 3. That the Mayor is hereby authorized and directed to execute the Franchise Agreement containing the major provisions described above and on such additional terms and conditions as the City Manager determines are in the best interests of the City and its citizens, and in a form acceptable to the City Attorney.
