HomeMy WebLinkAbout088 - 09/01/1992 - ADOPTING RULES AND REGULATIONS GOVERNING THE USE OF CITY CULTURAL, LIBRARY, AND RECREATIONAL SERVICE ORDINANCE NO. 88 , 1992 OF THE COUNCIL OF THE CITY OF FORT COLLINS ADOPTING RULES AND REGULATIONS GOVERNING THE USE OF CITY CULTURAL, LIBRARY, AND RECREATIONAL SERVICES FACILITIES WHEREAS, Section 23-201 of the Code of the City of Fort Collins, as recently amended, states that the government and control of the general public in the use and enjoyment of the public parks, the City-owned golf courses, recreation facilities and areas designated by the City as open spaces or trails, either within or outside the City limits, shall be in accordance with the rules and regulations adopted by the City Council by ordinance; and WHEREAS, the City Council has adopted Ordinance No. 62, 1988, which sets forth the rules and regulations governing the use of parks, open spaces and trails; and WHEREAS, the City Council desires to adopt rules and regulations to govern the use and enjoyment of the City' s public Cultural , Library and Recreational Services ("CLRS") facilities, including but not limited to: Edora Pool Ice Center, Fort Collins Community Pool , Northside Aztlan Community Center, Downtown Community Center, City Park Center, the Pottery Studio, the Senior Center, the Lincoln Center and adjacent Sculpture Garden, the Library, the Museum, the buildings and grounds of the City-owned golf courses, as well as the fenced confines of City Park Pool , Rolland Moore Racquet Complex and The Farm at Lee Martinez Park. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the following rules and regulations are hereby adopted to govern and control the general public's use and enjoyment of the City's public CLRS facilities: 1. No person without authorization from the manager of a CLRS facility shall enter or remain in or upon the grounds of a CLRS facility beyond posted or established hours . 2. No person or business entity shall sell or offer to sell any item for commercial gain in or upon the grounds of any CLRS facility without a permit or grant of concession rights from the City. 3. No person shall utilize any CLRS facility to conduct any private or group instruction or conduct a service for commercial gain without first obtaining a permit from the City for the same. Permits shall be issued only to applicants meeting the requirements established by the City's Director of Cultural , Library and Recreational Services. 4. No person shall use trash receptacles located inside or on the CLRS facility grounds for the dumping of trash generated from outside the CLRS facility. 5. Except for CLRS facilities that are properly licensed to sell alcoholic beverages, no malt, special malt, vinous or spirituous liquors or fermented malt beverages are allowed in or on the grounds of CLRS facilities, and the possession or drinking of such beverages in or on the grounds of such CLRS facilities is prohibited. 6. The City Manager or his designee is authorized to promulgate reasonable rules and regulations concerning the time, place and manner for: (a) depositing, fastening, posting, handing out, delivering or distributing flyers, handbills, posters, business cards or other advertising devices; (b) demonstrations; (c) parades; (d) protests; (e) the solicitation of contributions; (f) the gathering of signatures; and (g) any other activity, in or upon the grounds of a CLRS facility, to prevent such activity from interfering with the normal and customary operation or use of such facility. No person shall violate any such rule or regulation. These rules and regulations shall be filed with the City Clerk, who shall make them available to all interested members of the public and who shall publish notice of such filing. 7. Smoking or carrying a lighted smoking instrument in CLRS facilities is prohibited, except in designated smoking areas and except where smoking or carrying a lighted smoking instrument is part of a performance or activity at such facility. 8. No person shall knowi gly injure, damage or destroy real or personal property, nor injure, deface, destroy or remove signs, notices or markers in or upon the grounds of any CLRS facility. 9. Any person or persons not using a CLRS facility or program for its intended purpose, or conducting himself or herself in a manner which jeopardizes a person's safety or interferes with the normal and customary operation or use of the CLRS facility or which violates the rules or regulations established for a particular CLRS facility or program may be evicted from the facility. 10. No animals or pets are allowed in CLRS facilities without the authorization of the manager of the facility, except those required by qualified, disabled individuals (as defined in the Americans With Disabilities Act) in order for them to properly utilize the facility. 11 . No person shall use inline or roller skates or skate boards within a CLRS facility without the written authorization of the manager of the CLRS facility. The knowing violation of any rule or regulation governing the use and enjoyment of a City public CLRS facility shall constitute a violation of the City Code punishable as provided in Section 1-15 of the City Code.
