OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO EXECUTE A UTILITY EASEMENT
IN FAVOR OF PUBLIC SERVICE COMPANY OF COLORADO
WHEREAS, the City of Fort Collins is the owner of a certain parcel of real
property known as the Pine Ridge Recreation Area ("the Property") ; and
WHEREAS, Public Service Company of Colorado wishes to acquire a non-
exclusive utility easement in the Property to construct, operate, maintain,
repair and replace utility lines; and
WHEREAS, under Section 23-111 of the City Code, the City Council must find
by ordinance that any sale or other disposition of real property owned by the
City is in the best interest of the City of Fort Collins.
WHEREAS, the granting of this easement will allow for approximately .25
miles of overhead power lines to be removed from City open space property.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
1 . That the above-described sale and conveyance of an easement interest
in the Property is in the best interests of the City of Fort Collins.
2. That the Mayor be, and hereby is, authorized to execute a non-
exclusive Utility Easement in the Property in favor of Public Service Company of
Colorado, consisting of approximately 1.3 acres in the West half of Section 29,
Township 7 North, Range 69 West of the Sixth Principal Meridian, City of Fort
Collins, Larimer County, Colorado, which easement is more particularly described
in the The Description of a Permanent Utility Easement to be Granted to Public
Service Company located in the Pine Ridge Recreation Area, " dated June 3, 1992
on file with the Office of the City Clerk.
Introduced, considered favorably on first reading, and ordered published
this 21st day of July, 1992, and to be presented for final passage on the 15th
day of September, A.D. 1992.
