HomeMy WebLinkAbout023 - 02/20/2001 - AMENDING CITY CODE BY ADDING A NEW ARTICLE TO CHAPTER 7 RELATING TO INITIATIVE AND REFERENDUM ORDINANCE NO. 23, 2001 OF THE COUNCIL OF THE CITY OF FORT COLLINS ADDING A NEW ARTICLE VI TO CHAPTER 7 OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO INITIATIVE AND REFERENDUM WHEREAS,Section 31-11-111 of the Colorado Revised Statutes relating to ballot titles for municipal initiatives,referenda,and referred measures provides that any protest concerning a ballot title shall be conducted as provided by local charter, ordinance, or resolution; and WHEREAS, a protest procedure has not previously been established in the City Charter or by adoption of an ordinance or resolution; and WHEREAS, staff has recommended that a protest procedure be established in Chapter 7 of the Code of the City of Fort Collins, which chapter contains other provisions relating to municipal elections. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Chapter 7 of the Code of the City of Fort Collins be amended by the addition of a new Article VI to read as follows: ARTICLE VI. INITIATIVE AND REFERENDUM Sec. 7-155. Generally. The manner of exercising the powers of initiative and referendum with regard to ordinances and resolutions of the city shall be governed by the provisions of this Article and the provisions of Article X of the Charter. Any matter not covered by the state Constitution, this Article, or other provisions of the Code shall be governed by the laws of the state relating thereto. Sec. 7-156. Protests of proposed ballot title and/or submission clause. Any registered elector desiring to protest a proposed ballot title and/or submission clause for any initiated or referred measure may file a written protest in the office of the City Clerk. Said notice of protest shall be filed no later than 12:00 p.m. on the Monday immediately preceding the date upon which the City Council will consider the resolution setting the ballot title and submission clause. The notice of protest shall set forth with particularity the grounds of the protest. Such protest shall be heard, considered and resolved by the City Council prior to the adoption of said resolution.
