HomeMy WebLinkAbout009 - 02/06/2001 - APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND FOR GATEWAY MOUNTAIN PARK ORDINANCE NO. 9, 2001 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND FOR GATEWAY MOUNTAIN PARK WHEREAS,the City of Fort Collins owns a 400-acre site located approximately five miles up the Poudre Canyon, which property was formerly known as the City's Water Treatment Plant No.1, a portion of which will be developed as Gateway Mountain Park; and WHEREAS, in order to make the Park accessible to the public, it will be necessary to complete a realignment of and substantial improvements to the entry road to the Park from Highway 14(the"Park Road Project"),plans for which originally called for an estimated construction cost of $1,120,000; and WHEREAS,City Council adopted Resolution 98-113,on August 18, 1998, authorizing the City to contract with the Colorado Department of Transportation ("CDOT")for the realignment of the entry road to Gateway Mountain Park; and WHEREAS, on September 1, 1998, City Council adopted Ordinance No. 135, 1998, appropriating$664,000 to be used for improvements associated with the Park Road Project,with the understanding that the remaining funds ($456,000) would be appropriated in 1999 and 2000; and WHEREAS, CDOT has previously made available an additional $59,000 in 1999 and $170,000 in.2000 to be used for the Park Road Project and Council appropriated these funds pursuant to Ordinance No. 71, 1999, and Ordinance No. 5, 2000; and WHEREAS, the revised estimate for design and construction of the Park Road Project reflects a reduction from $1,120,000 to $893,000 due to changes in the original design, lower than anticipated construction costs, and requests from Great Outdoors Colorado and the Colorado Division of Wildlife that their funds be used for park development,rather than road improvements; and WHEREAS, CDOT has awarded the City with a Colorado Scenic and Historical Byways Grant, totaling$182,000, of which approximately $10,000 will be used for the Park Road Project, with remaining dollars to be used for development of Gateway Park; and WHEREAS,sufficient City funds($78,000)were appropriated in Ordinance No. 135, 1998, to match 30% of the new grant total; and WHEREAS, City Council adopted Resolution 2001-7, on January 16, 2001, authorizing an intergovernmental agreement between the City of Fort Collins and the Colorado Department of Transportation for the provision of $182,000 in Scenic and Historical Byways grant funding for Gateway Mountain Park, including the Park Road Project; and WHEREAS,Article V,Section 9, of the Charter of the City of Fort Collins permits the City Council to make supplemental appropriations, by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year,do not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,it is the desire of the Council to appropriate the Colorado Scenic and Historical Byways grant funds received from CDOT,totaling$182,000,in the Capital Projects Fund,Gateway Mountain Park capital project, to be used for the design and development of the access road and development of Gateway Mountain Park. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the Capital Projects Fund, Gateway Mountain Park capital project, the sum of ONE HUNDRED EIGHTY-TWO THOUSAND DOLLARS($182,000),from Colorado Department of Transportation Colorado Scenic and Historical Byways grant funds, to be used for the design and development of the access road and development of Gateway Mountain Park. Introduced, considered favorably on first reading and ordered published this 16th day of January, A.D. 2001, and to be presented for final passage on the 6th day of February, A.D. 2001.
