HomeMy WebLinkAbout006 - 01/16/2001 - AUTHORIZING THE CITY TO GRANT A NON-EXCLUSIVE EASEMENT ON MEADOW SPRINGS RANCH TO NUNN TELEPHONE COM ORDINANCE NO. 6, 2001 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY TO GRANT A NON-EXCLUSIVE EASEMENT ON MEADOW SPRINGS RANCH TO NUNN TELEPHONE COMPANY WHEREAS,the City of Fort Collins Utility is the owner of the property known as Meadow Springs Ranch in Larimer County, Colorado (hereinafter referred to as the "Ranch"); and WHEREAS, Nunn Telephone Company has been requested by the owners of the Diehl Ranch,which abuts the Meadow Springs Ranch,to provide telephone service to their property; and WHEREAS, the most direct way to provide telephone service to the Diehl Ranch is across the Ranch within an existing Poudre Valley Rural Electric Association non-exclusive easement, recorded September 7, 1999 at Reception No. 2718897 in the Weld County Clerk and Recorder's Office; and WHEREAS, Nunn Telephone Company has requested a 20-foot wide non-exclusive easement(2.42 acres)for installation and maintenance of an underground telephone line across the Ranch as legally described on Exhibit"A", attached hereto and incorporated herein by this reference (the "Easement"); and WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized to sell, convey or otherwise dispose of real property owned by the City, provided the Council first finds by ordinance that any sale or disposition of real property owned by the City will not materially impair the viability of any utility system as a whole of which the property is a part, will be for the benefit of the City's citizens and that the grant is in the best interest of the City of Fort Collins. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the above described conveyance of the Easement will not materially impair the viability of the City's utility as a whole, will be for the benefit of the City's citizens and that it is in the best interests of the City. Section 2. That the Mayor is authorized to execute such documents of conveyance as are necessary to convey the Easement interest to Nunn Telephone Company upon the terms and conditions described above. Introduced, considered favorably on first reading, and ordered published this 2nd day of January, A.D. 2001, and to be presented for final passage on the 16th ,4y of January, A.D. 2001. Mayor ATTEST: �" & V11h ."A A L City Clerk EXHIBIT "A" UTILITY EASEMENT DESCRIPTION A 20.00 foot wide utility easement situate in Section 7, Township 10 North, Range 67 West of the 61h P.M., Weld County, Colorado which considering the West line of the Southwest 1/4 of said Section 7 as bearing S'0030'52"E and with all bearings contained herein relative thereto and the easement is 10.00 feet on either side of the East-West centerline of said Section 7 which begins at the East 1/4 corner of said Section 7 and runs thence N'8938'42"W 5152.54 feet to the West 1/4 corner of said Section 7.
